A precarização do trabalho e a concepção de vida nua: os operadores de telemarketing no contexto da necropolítica

Resumo: The discussion about the precariousness of work, inevitably, involves an examination of the changes that are taking place in the world of work. In this aspect, one cannot forget the influence of the hegemony of capitalism, materialized by changes in labor rights and which lead to loss of wages, social benefits, safety and hygiene at work, union protection, as well as the loss of social protections. Among these changes in the world of work, the service sector surpassed industry as the segment that employs the most nowadays, and the new informational technologies created a list of jobs in the tertiary sector, with the call center telemarketing operators being highlighted. Although the function of the teleoperator is linked to the use of high-tech computers and systems, the techniques and methods applied in the organization and productivity of work are still similar to those previously observed in the manufacturing industry. Data from the Telemarketing Workers Union (SINTRATEL, c2016) related to occupational diseases indicate that 36% of these workers suffer from repetitive strain injury (RSI), 30% from psychological disorders, and 25% have some hearing or voice loss. Among the psychological disorders, there are reports of suicide. The alarming rates of illness at work in this category place these workers in a situation of Bare Life (AGAMBEN, 2002), once these companies promote organizational moral harassment, resulting in occupational illness, which can lead to death. In addition, the lack of action by the State through proper regulation, once it has been processed in the National Congress for more than ten years a Bill that regulates the profession of telemarketing operator, allows the act of letting the person die become acceptable, evidencing the manifestation of necropolitics (MBEMBE, 2018). Taking these considerations into account, the central question that drives this work is raised: Starting from an expanded understanding of the Agambenian concept of Bare Life, being practiced against today’s workers, especially telemarketing operators, what is the relationship between this experience of social lack of protection and the execution of the necropolitics perpetrated against these people and what are the implications of this relationship on the health of these workers and on the safeguarding of human and labor rights? The hypothesis is that the precariousness of work affects especially the telemarketing sector, in which the “flexibilization” of the working conditions of these workers is expressed in a very forceful way due to the structure of this sector, in which everything becomes precarious. Thus, in this thesis, the objective is to investigate the precariousness of work with a focus on the telemarketing sector, whether these workers fit into the concepts of bare life and necropolitics and what are the repercussions of this relationship on the health of these workers and on the safeguarding of human and labor rights. The understanding of the precariousness experienced by telemarketing operators was expanded (bare life and necropolitics) by approaching reality from the perspective of sociology of law. Bibliographic and field research are used and a qualitative analysis of the medical records provided by the Regional Reference Center in Occupational Health from João Pessoa- PB (CEREST-JP), for the period from 2018 to 2021. From the assessment of the medical records, in this study, the hypothesis that telemarketing operators are affected by occupational illnesses arising from the precariousness of relationships in the work environment is confirmed.

La discusión sobre la precariedad del trabajo pasa, inevitablemente, por el examen de los cambios que se están produciendo en el mundo del trabajo. En este aspecto, no se puede olvidar la influencia de la hegemonía del capitalismo, materializada por cambios en los derechos laborales y que conducen a la pérdida de salarios, beneficios sociales, seguridad e higiene en el trabajo, protección sindical, así como la pérdida de la protección social. Entre estos cambios en el mundo del trabajo, el sector servicios superó a la industria como el segmento que más emplea en la actualidad, y las nuevas tecnologías de la información han creado una lista de puestos de trabajo en el sector terciario, destacando los operadores de telemarketing de call center. Aunque la función del teleoperador está ligada al uso de computadoras y sistemas de alta tecnología, las técnicas y métodos aplicados en la organización y productividad del trabajo siguen siendo similares a los previamente observados en la industria manufacturera. Los datos del Sindicato de Trabajadores de Telemarketing (SINTRATEL, c2016) relacionados con enfermedades ocupacionales indican que el 36% de estos trabajadores sufren de lesiones por esfuerzo repetitivo (LER), el 30% de trastornos psicológicos y el 25% tiene alguna pérdida de audición o voz. Entre los trastornos psicológicos, hay informes de suicidio. Los alarmantes índices de enfermedad en el trabajo en esta categoría colocan a estos trabajadores en una situación de Nuda Vida (AGAMBEN, 2002), ya que estas empresas promueven el acoso moral organizacional, resultando en enfermedades ocupacionales, que pueden conducir a la muerte. Además, la falta de actuación del Estado a través de la debida regulación, ya que lleva en el Congreso Nacional más de diez años, un Proyecto de Ley que regula la profesión de operador de telemarketing, permite lo dejar morir se torna aceptable, evidenciando la manifestación de necropolítica (MBEMBE, 2018). Teniendo en cuenta estas consideraciones, se plantea la cuestión central que impulsa este trabajo: A partir de una comprensión ampliada del concepto agambeniano de Nuda Vida, que se practica contra los trabajadores de hoy, especialmente los teleoperadores, ¿cuál es la relación entre esta experiencia de desprotección social y la ejecución de la necropolítica perpetradas contra estas personas y cuáles son las implicaciones? de esta relación en la salud de estos trabajadores y en la salvaguarda de los derechos humanos y laborales? La hipótesis es que la precariedad laboral afecta especialmente al sector del telemarketing, en el que la “flexibilización” de las condiciones laborales de estos trabajadores se expresa de forma muy contundente debido a la estructura de este sector, en el que todo se vuelve precario. Así, el objetivo es investigar la precariedad del trabajo con foco en el sector del telemarketing, si estos trabajadores encajan en las concepciones de Nuda Vida y necropolítica y cuáles son las repercusiones de esta relación en la salud de estos trabajadores y en la salvaguarda de los derechos humanos y laborales. La comprensión de la precariedad vivida por los teleoperadores se amplificó (Nuda Vida y Necropolítica) al abordar la realidad desde la perspectiva de la sociología jurídica. Se utiliza investigación bibliográfica y de campo y se desarrolla un análisis cualitativo de los registros médicos proporcionados por el Centro Regional de Referencia de Salud Ocupacional (CEREST-JP) de João Pessoa-PB, para el período de 2018 a 2021. A partir del análisis de las historias clínicas, en este estudio se confirma la hipótesis de que los teleoperadores se ven afectados por enfermedades ocupacionales derivadas de la precariedad de las relaciones en el ámbito laboral.Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPESA discussão acerca da precarização do trabalho, inevitavelmente, passa pelo exame das modificações que estão acontecendo no universo do trabalho. Nesse aspecto, não se pode olvidar a influência da hegemonia do capitalismo, materializada pelas mudanças nos direitos trabalhistas e que acarretam perdas salariais, de benefícios sociais, de segurança e higiene no trabalho, de proteção sindical, bem como a perda das proteções sociais. Dentre essas mutações do mundo do trabalho, o setor de serviços superou a indústria como segmento que mais emprega hodiernamente, e as novas tecnologias informacionais criaram um rol de empregos no setor terciário, ganhando destaque os operadores de telemarketing de Call Centers. Apesar de a função do teleoperador estar atrelada ao uso de computadores e sistemas de alta tecnologia, as técnicas e métodos aplicados na organização e na produtividade do trabalho ainda se assemelham àquelas antes observadas na indústria de transformação. Dados do Sindicato dos Trabalhadores em Telemarketing (SINTRATEL, c2016) relacionados a doenças do trabalho apontam que 36% desses trabalhadores sofrem de lesão por esforço repetitivo (LER), 30%, de transtornos psíquicos, e 25% apresentam alguma perda auditiva ou de voz. Dentre os transtornos psíquicos, há relatos de suicídio. Os índices alarmantes de adoecimento no trabalho dessa categoria colocam esses trabalhadores em situação de Vida Nua (AGAMBEN, 2002), visto que essas empresas promovem o assédio moral organizacional, acarretando a enfermidade laboral, que pode levar até a morte. Além disso, a falta de ação pelo Estado por meio de uma regulamentação adequada, uma vez que tramita no Congresso Nacional há mais de dez anos Projeto de Lei que regulamenta a profissão de operador de telemarketing, permite que o deixar morrer se torne aceitável, evidenciando a manifestação da necropolítica (MBEMBE, 2018). Levando-se em consideração essas ponderações, soergue-se a questão central que conduz este trabalho: Partindo-se de uma compreensão ampliada do conceito agambeniano de Vida Nua, sendo praticada contra os trabalhadores hodiernos, sobretudo, os operadores de telemarketing, qual a relação entre essa vivência de desproteção social e a execução da necropolítica perpetrada contra essas pessoas e quais as implicações dessa relação na saúde desses trabalhadores e na salvaguarda de direitos humanos e trabalhistas? A hipótese é que a precarização do trabalho atinge especialmente o setor de telemarketing, no qual a “flexibilização” das condições laborais desses trabalhadores se expressa de maneira bastante contundente devido à própria estrutura desse setor, no qual tudo se converte em precariedade. Assim, objetiva-se investigar a precarização do trabalho com enfoque no setor de telemarketing, se esses trabalhadores se enquadram nas concepções de vida nua e necropolítica e quais as repercussões dessa relação na saúde desses trabalhadores e na salvaguarda dos direitos humanos e trabalhistas. A compreensão da precarização vivenciada pelos operadores de telemarketing restou ampliada (vida nua e necropolítica) pela abordagem da realidade na perspectiva da sociologia jurídica. Faz-se uso da pesquisa bibliográfica e de campo e desenvolve-se uma análise qualitativa dos prontuários disponibilizados pelo Centro Regional de Referência em Saúde do Trabalhador de João Pessoa-PB (CEREST-JP), referentes ao período de 2018 a 2021.
