Estado de exceção e estado democrático de direito: violência e poder no pensamento de Walter Benjamin

Resumo: | Our thesis work is situated in the criticism of the modern state, especially in the form that this assumes in the historical context of the first half of the twentieth century. Here, the state starts to act from the rule of exception, which means to say that it acts on a contradiction guided by the binomial inclusion-exclusion of individuals through the Law. We start from this debate found in Walter Benjamin's work to investigate the conditions of democracy and sovereignty today. To this end, we investigate the problem in the work of the German philosopher through his philosophy of history, which functions as the method for ascertaining the historical conditions of class struggle and for proposing a new historical paradigm found in understanding the tradition of the vanquished. From then on, we look at the concept of state of exception, in search of its forms, namely, the state of permanent exception and the “true” state of exception. In this journey, we seek to understand the concept of sovereign power by the articulation between two forms, the constituent power and the constituted power to then think the antithesis of the destituent power, a concept which conforms to the introduction of the emergence of the true exception. These questions are guided by the idea of criticism of violence, a concept present in Benjamin’s thought in two moments: as violence that founds the exception and as another type of violence, that disrupts its mythical circuit in the form of law. We are going to investigate the philosophical question of the state of exception to point out in the work of the German philosopher the understanding that sovereign power and its representational mechanism form a type of violence from its origin, substantiated by the paradigm of sovereignty. This criticism of representation supports the problem of democratic achievement, which is expressed in the hypothesis that the rule of law includes the state of exception as a necessity of its operation, which enables us to defend revolutionary violence, here, in the way Benjamin defines it, as pure violence. |

Qui, lo stato ora funziona da eccezione alla regola, il che significa che agisce su una contraddizione guidata dal binomio inclusione-esclusione di individui per mezzo della legge. Iniziamo questo dibattito trovato nel lavoro di Walter Benjamin per indagare le condizioni della democrazia e della sovranità oggi. Pertanto, abbiamo studiato il problema nel lavoro filosofo tedesco attraverso la sua filosofia della storia, che serve come il metodo per l'indagine delle condizioni storiche della lotta di classe e per portare un nuovo paradigma storico trovato nella comprensione della tradizione dei vinti. Da lì ci guardiamo indietro sul concetto di stato di emergenza, alla ricerca delle sue forme, vale a dire lo stato di eccezione permanente e lo “vero” stato d'eccezione. In questo modo, cerchiamo di capire il concetto di potere sovrano da parte l'articolazione tra due forme, il potere costituente e potere costituito per poi pensare l'antitesi del concetto di potere destituinte che modella l'istituzione della comparsa d'eccezione reale. Questi problemi sono guidati da l'idea della critica della violenza, concetto presente al pensiero di Benjamin in due fasi: la violenza che ha fondato l'eccezione e come un altro tipo di violenza che sconvolge il loro circuito mitico in forma di legge. Indaghiamo la questione filosofica dello stato di emergenza si segnala per il filosofo tedesco lavorare la consapevolezza che il potere sovrano e il suo meccanismo di rappresentazione conformano una violenza dalla sua origine, incarnata dal paradigma della sovranità. Questa critica della rappresentazione supporta la questione della condotta democratica, che si esprime sul presupposto che lo stato di diritto comprende lo stato di emergenza come la necessità per il proprio funzionamento, che ci consente di difesa della violenza rivoluzionaria qui nel suo modo Benjamin lo definisce come violenza pura.Conselho Nacional de Pesquisa e Desenvolvimento Científico e Tecnológico - CNPqNosso trabalho de tese situa-se na crítica ao Estado moderno, sobretudo na forma que este assume no contexto histórico da primeira metade do século XX. Aqui, o Estado passa a atuar a partir da regra da exceção, o que significa dizer que atua sobre uma contradição pautada pelo binômio inclusão-exclusão dos indivíduos pela via do direito. Partimos deste debate encontrado na obra de Walter Benjamin para investigarmos as condições da democracia e da soberania na atualidade. Para tanto, investigamos a problemática na obra do filósofo alemão através da sua filosofia da história, que funciona como o método para a averiguação das condições históricas da luta de classes e para a propositura de um novo paradigma histórico encontrado na compreensão da tradição dos vencidos. A partir daí nos debruçamos sobre o conceito de estado de exceção em busca de suas formas; a saber, o estado de exceção permanente e o “verdadeiro” estado de exceção. Neste percurso, buscamos compreender o conceito de poder soberano pela articulação entre duas formas, o poder constituinte e o poder constituído para, em seguida, pensar a antítese do poder destituinte, conceito que conforma a instauração da emergência da exceção verdadeira. Estas questões são orientadas pela ideia da crítica da violência, conceito presente no pensamento de Benjamin em dois momentos: como violência que funda a exceção e como outro tipo de violência, que interrompe o seu circuito mítico da forma do direito. Investigaremos a questão filosófica do estado de exceção para apontarmos na obra do filósofo alemão a compreensão de que o poder soberano e seu mecanismo representacional conformam uma violência desde sua origem, consubstanciada pelo paradigma da soberania.
