A justiça restaurativa na política de socioeducação: concepções, crítica e possibilidades

Resumo: | The present thesis aims to analyze the Restorative Justice (RJ) within the scope of the Socioeducation Policy. According to its most widely used concept, JR can be understood as the process by which the parties involved in a specific offense collectively resolve how to deal with the consequences of the offense and its future implications. It is assumed, in this thesis, that: Restorative Justice is situated in a context of partnership between State and civil society; in the policy of Socioeducation RJ enters through the justice system, characterizing a response of the State to the issue of the infraction, through consensus; in considering crime as a violation of people and relationships, RJ presents an interpersonal approach, not provoking structural transformations; despite this, the RJ may present itself as a counter-hegemonic possibility, representing a tool that provides young users of the Socioeducation Policy with listening and participation. Based on these assumptions, it is argued that Restorative Justice in SocioEducation Policy is characterized as a response of the State through consensus and epistemological basis in interpersonal relations, revealing an instrument of guarantee of rights, as the right to participate. Based on a critical perspective, the theoretical categories Social Policy and Restorative Justice were used. Regarding the method, the thesis research was carried out in six Brazilian municipalities, in the north, northeast, south and center-west regions. Twenty professionals working with RJ participated in the research in the scope of socioeducational policy. As instrument, semi-structured interviews were used, recorded, transcribed and submitted to analysis with the help of MaxQDA software. The results of the interviews were organized in three categories: Restorative Justice, Restorative Justice as Public Policy and Restorative Justice in Socioeducation. Overall, the data points to the existence of RJ’s understanding as a new conception of justice. The predominant theoreticalepistemological perspective elucidated the focus on interpersonal relations. The justice system has been identified as the main actor in relation to the RJ as public policy, participating in both the implementation and execution of the policy, seeming to represent an instrument of the State in the consensus articulation. However, the State's actions were also identified in partnership with civil society, represented, for example, by non-governmental organizations. With regard to Socioeducation, the data pointed out that RJ practices are used in the community, in the judicial context and in the execution of socioeducational measures. The most commonly used restorative practice are peacebuilding circles, restorative meetings, and conflict mediation; it has been noticed that they have been used as a new resource for acting with the young people in the socioeducation process, which allows reception and listening. In view of the results, the thesis is confirmed that Restorative Justice in socioeducational policy is characterized as a response of the State that has epistemological basis in interpersonal relations, revealing an instrument of guarantee of rights, such as to participate. |

Según su concepto más utilizado, la JR puede ser entendida como el proceso por el cual las partes involucradas en una específica ofensa resuelven colectivamente cómo lidiar con las consecuencias de la ofensa y sus implicaciones para el futuro. Se presupone, en esta tesis, que: la Justicia Restaurativa está situada en un contexto de asociación entre Estado y sociedad civil; en la política de Socioeducación la JR adentra por la vía del sistema de justicia, caracterizando una respuesta del Estado a la cuestión del acto infraccional, por medio del consenso; al considerar el crimen como violación de personas y relaciones, la JR presenta un enfoque interpersonal, no suscitando transformaciones estructurales; a pesar de eso, la JR puede presentarse como una posibilidad contra hegemónica, representando una herramienta que proporciona a los jóvenes usuarios de la Política de Socioeducación la escucha y la participación. A partir de estos presupuestos, se defiende la Tesis de que la Justicia Restaurativa en la Política de Socioeducación se caracteriza como una respuesta del Estado, por medio del consenso, y con base epistemológica en las relaciones interpersonales, revelándose un instrumento de garantía de derechos, como el derecho de participar. Apoyada en una perspectiva crítica, se utilizaron las categorías teóricas Política Social y Justicia Restaurativa. En relación al método, la investigación de tesis se realizó en seis municipios brasileños, en las regiones norte, nordeste, sur y centro-oeste. Participaron 20 profesionales que trabajan con JR en el marco de la política de socioeducación. Como instrumento se utilizaron entrevistas semiestructuradas, las cuales fueron grabadas, transcritas y sometidas al análisis con el auxilio del software MaxQDA. Los resultados de las entrevistas fueron organizados en tres categorías: Justicia Restaurativa, Justicia Restaurativa como Política Pública y Justicia Restaurativa en la Socioeducación. En general, los datos apuntan a la existencia de la comprensión de la JR como una nueva concepción de la justicia. La perspectiva teórico-epistemológica predominante elucidó el foco en las relaciones interpersonales. El sistema de justicia fue identificado como el principal actor en lo que se refiere a la JR como política pública, participando tanto de la implantación y de la ejecución de la política, pareciendo representar un instrumento del Estado en la articulación del consenso. Sin embargo, se identificó también la actuación del Estado en asociación con la sociedad civil, representada, por ejemplo, por organizaciones no gubernamentales. En lo que se refiere a la Socioeducación, los datos apuntaron que las prácticas de JR se utilizan en la comunidad, en el contexto judicial y en la ejecución de las medidas socioeducativas. La práctica restaurativa más utilizadas son los círculos de construcción de paz. Se percibió que la JR han sido utilizadas como un nuevo recurso para actuación con los jóvenes en la socioeducación, que posibilita acogida y escucha. Ante los resultados, se corrobora la tesis de que Justicia Restaurativa en la Política de Socioeducación se caracteriza como una respuesta del Estado que tiene base epistemológica en las relaciones interpersonales, revelándose un instrumento de garantía de derechos, como el derecho de participar.NenhumaA presente tese tem como objetivo analisar a Justiça Restaurativa (JR) no âmbito da Política de Socioeducação. Tem-se como pressupostos que: a Justiça Restaurativa está situada num contexto de parceria Estado e sociedade civil; na política de Socioeducação a JR adentra pela via do sistema de justiça, caracterizando uma resposta do Estado à questão do ato infracional, por meio do consenso; ao considerar o crime como violação de pessoas e relacionamentos, a JR apresenta um enfoque interpessoal, não suscitando transformações estruturais; apesar disso, a JR pode se apresentar como uma possibilidade contra hegemônica, representando uma ferramenta que proporciona aos jovens usuários da Política de Socioeducação a escuta e a participação. A partir desses pressupostos, defende-se a Tese de que a Justiça Restaurativa é uma resposta do Estado por meio do consenso, que tem sua base epistemológica nas relações interpessoais, revelando-se, na Política de Socioeducação, um instrumento de garantia de direitos, como o direito de participação. Entretanto, foi identificada também a atuação do Estado em parceria com a sociedade civil, representada, por exemplo, por organizações não governamentais. No que se refere à Socioeducação, os dados apontaram que as práticas de JR são utilizadas na comunidade, no contexto judicial e na execução das medidas socioeducativas. A prática restaurativa mais utilizada são os círculos de construção de paz. Percebeu-se que a JR tem sido usada como um novo recurso para atuação com os jovens na socioeducação, que possibilita acolhimento e escuta.
