Resumo: The performance of the Inter-American Court of Human Rights (I/A Court H.R.), as much in a contentious as in an advisory way, starts to establish milestones in human rights multilevel protection, signing interpretations concerning the Convention of the Rights of Man, by means of Advisory Opinions requested by the States or even by the Inter-American Commission on Human Rights (IACHR) itself, being also the object of analysis for the San Jose Courthouse the recognition of a national margin of appreciation. In this context, using the deductive research approach, through the analysis of a solicitation of advisory opinion about the legal guarantees in political judgments, it is asked: — Does the Inter-American Court recognize a national margin of appreciation regarding the legal guarantees in impeachment processes? For this purpose, in the first moment, the advisory and contentious functions of this body of the Inter-American Protection System is addressed, in order to, then, analyze the resolution concerning the cited advisory opinion. It is possible to conclude the recognition, by the Courthouse, of a national margin of appreciation regarding the legal guarantees and the control of impeachment processes, guaranteeing the States a space of discretion while handling this topic.

It is possible to conclude the recognition, by the Courthouse, of a national margin of appreciation regarding the legal guarantees and the control of impeachment processes, guaranteeing the States a space of discretion while handling this topic.A atuação da Corte Interamericana de Direitos Humanos (Corte IDH), tanto de forma contenciosa como consultiva, passa a estabelecer marcos na proteção multinível de direitos humanos, firmando interpretações sobre a Convenção sobre Direitos do Homem, por meio de Opiniões Consultivas solicitadas pelos Estados ou mesmo pela própria Comissão Interamericana de Direitos Humanos (CIDH), sendo objeto de análise pela Corte de San José também o reconhecimento de uma margem de apreciação nacional. Diante disto, utilizando-se como método de abordagem o dedutivo, a partir da análise de solicitação de opinião consultiva sobre as garantias judiciais em juízos políticos, questiona-se: — Reconhece a Corte Interamericana uma margem de apreciação nacional no que se refere às garantias judiciais em processos de impeachment? Para tanto, discutem-se, em um primeiro momento, as funções consultiva e contenciosa desse órgão do Sistema Interamericano de Proteção, para, então, discutir-se a teoria da margem de apreciação nacional e, ao final, analisar-se a resolução relativa à opinião consultiva citada.
