É veiculada através de processo de cognição exauriente, satisfativo, apto à formação da coisa julgada material, não se confundindo com as tutelas cautelar, ressarcitória, antecipatória ou declaratória. Pode, no entanto, cumular-se com outras tutelas, a exemplo da ressarcitória e da antecipatória. Normalmente reveste-se de caráter mandamental, quando o juiz ordena ao devedor um fazer ou não-fazer ou de provimento executivo lato sensu, em que os stos são praticadospelos agentes do Poder Judiciário ou por terceiros, por determinação do juiz. É aplicável a direitos absolutos e relativos, patrimoniais e extrapatrimoniais. Ao lado das hipóteses típicas de tutela inibitória, há no ordenamentojurídico um princípio geral de prevenção. A possibilidade de liminar, com antecipação do resultado de mérito, bem como de utilização de medidas coercitivas são fundamentais para a efetividade da tutela inibitória. Há, no entanto, limites à aplicação da tutela inibitória, consubstanciados no princípio geral da necessidade e suas espécies: do meiomais idôneo, da menor restrição possível e da proporcionabilidade. Legislação infraconstitucional não pode impedir o aviamento da tutela inibitória, nem obrigar o interessado a submeter-se previamente a órgãos extrajudiciais.Abstract: This dissertation deals with the study of inhibitorial or preventive tutorship - "injunction" - in the individual work process, as one which prevents the illegal, illicit or damaging behavior. This tutorship is spread out by means of a comprehensive and satisfying cognition process which supports the formation of something which is evidently material; it should not be misinterpreted as tutorial, indemnifying, anticipated or constitutive tickets. It may however, be cumulative with indemnifying or antecipated tutorship. It usually is of mandatorial nature, when the judge tells the one who owes money to follow a kind of do-it or do-not-do-it executive lato sensu action; all actions are held by the Judiciary Power or somebody else who is nominated by the judge. It is also applied to absolute and relative, patrimonial and extrapatrimonial rights; there is a general preventive principle in the judicial order system. There may be liminals, thus anticipating merit result and coercive practices which are absolutely necessary in case of inhibitorial tutorship. However, there are limits to the application of inhibitorial tutorship, based upon the general principle of needs and its kinds: the fairest, the least restrictive and the most proportional.
