Defesa: Curitiba, 18/05/2016Inclui referências : f. 230-250Área de concentração : Direito do EstadoResumo: A presente tese de doutoramento tem por objetivo apresentar um aporte teórico e normativo para lidar com a questão da possibilidade/necessidade de criação, no Brasil, de um órgão de implementação de sentenças proferidas pela Corte Interamericana de Direitos Humanos (CIDH). Para isso, a partir de uma análise exploratória, reúne um arcabouço teórico e crítico capaz de fundamentar a futura proposição de um órgão de implementação alinhado ao Direito Internacional dos Direitos Humanos. Dois argumentos iniciais compõem o núcleo intitulado possibilidade de criação do órgão no Brasil. O primeiro discute o lugar da fala dos direitos humanos e suas possibilidades emancipadoras. O segundo analisa desafios postos ao constitucionalismo interno ante o Direito Internacional e sua relação com o bloco de convencionalidade. Outros dois argumentos tratam da necessidade de criação do órgão. Nesse processo, discute o estado da arte da atuação da CIDH no Brasil, cuja implementação de suas decisões mostra-se um ato complexo, multifacetado e, atualmente, deficitário. O último argumento analisa a proposição inédita chamada paradoxo do cumprimento pelo violador, fenômeno pelo qual o Poder Judiciário, simultaneamente, pratica ato ilícito internacional e executa a sentença condenatória dele decorrente. Finalmente, de posse do referencial teórico coletado, a tese apresenta uma perspectiva inovadora no tocante à criação de um órgão de implementação das sentenças proferidas pela CIDH, afirmando que esse deve, necessariamente, ser híbrido, aberto e plural, atuante numa dinâmica dialógica, pois, assim, seria capaz de enfrentar o paradoxo do cumprimento pelo violador e a maioria dos desafios aqui discutidos. Palavras-chave: Corte Interamericana de Direitos Humanos; sentenças; Poder Judiciário; mecanismos de implementação.Abstract: This doctoral thesis aims to present a theoretical and normative contribution to deal with the question of the possibility / need to create, in Brazil, an implementing body of judgments of the Inter-American Court of Human Rights (IACHR). For this, it brings together a theoretical and critical framework able to support the future proposition of an implementing agency in line with the International Law of Human Rights. Two initial arguments make up the core entitled possibility of creating the agency in Brazil. The first discusses the place of speech of human rights and its emancipatory possibilities. The second analyzes the challenges posed to the domestic constitutionalism under the International Law and its relationship with the conventionality block. Two other arguments address the need for the creation of the organ. In this process, They discuss the state of the art performance of the IACHR in Brazil, dealing with the implementation of its decisions as a complex, multifaceted act and currently unprofitable. The last argument examines the unprecedented proposition called paradox of compliance of the offender, a phenomenon by which the Judiciary simultaneously practices international tort and executes the sentence hereunder. Finally, the collected theoretical possession of the thesis presents an innovative perspective regarding the creation of an implementing body of judgments of the IACHR, stating that this must necessarily be hybrid, open and plural, active in a dialogic dynamic because thus it would be able to face the paradox of compliance of the offender and most of the challenges discussed here.
