Em um primeiro momento apresenta-se o conceito de neutralidade de rede, observando duas abordagens sobre a temática, uma primeira que a trata no plano econômico, frente ao qual a neutralidade poderia ser vista enquanto um óbice ao desenvolvimento e acesso a internet pela maioria da população; uma segunda visão a vê enquanto um fim a ser resguardado por promover um acesso mais igualitário, ainda que se discuta acerca dos métodos dessa proteção. Em um segundo momento o artigo faz uma análise do tratamento legislativo e jurisprudencial na matéria a nível nacional e internacional, abordando o Marco Civil da Internet, entre outros diplomas legais. Por fim, aborda-se o direito fundamental à informação, o qual determina que deve-se garantir a todas as pessoas a maior quantia de informação, advinda do maior número de fontes e análises possível, dessa forma tal postulado entra em confronto direto com a hipótese de restrição da neutralidade de rede, em vista das possibilidades de cerceamento das alternativas de acesso a conteúdo informacional, exigindo uma interpretação conforme dos dispositivos do Marco Civil.Abstract: The article investigates the legal treatment given to network neutrality from the perspective of the defense of fundamental rights, especially the right to information. At first, the concept of network neutrality is presented, observing two approaches on the subject, the first deals with it from a economic perspective, according to which neutrality could be seen as an obstacle to the development and access to the Internet by most of the population; a second view consider it as an end, that needs to be protected by promoting more egalitarian access, even if the methods of such guard are discussed. In a second moment, the article analyzes the legislative and jurisprudential treatment in the matter at national and international level, addressing the Internet Law Framework, among other legal texts.
