Defesa: Curitiba, 16/09/2015Inclui referências : f. 73-77Resumo: Este trabalho analisa, com base em pressupostos teóricos da AD francesa de vertente pecheutiana, de que maneira a promulgação da Lei 6.683/1979 (Lei da Anistia), que regulamenta socialmente a condição de anistiado, instaura dois sujeitos: o anistiado e, por oposição, o não anistiado, a partir de domínios de memória relacionados ao entorno mesmo da designação anistiado. Ao ser instaurado, o sujeito anistiado é falado de duas posições-sujeito: anistiado político e anistiado conexo. O primeiro se configura como aquele que recebeu o perdão do Estado por um crime cometido contra o Estado; o segundo é o considerado criminoso conexo, cuja definição se estende aos agentes de Estado. A posição-sujeito não anistiado engloba a figura do subversivo, cujo pré-construído remete àquele que recebeu a anistia, ou aquele a quem a anistia seria destinada. Entretanto, o texto da Lei, submetido à ordem do equívoco, aquilo que Pêcheux designou como a possibilidade de o sentido configurar-se como deslizamento para diferentes filiações, segue na direção contrária à expectativa sinalizada e gera o efeito de que o indivíduo designado subversivo não teve direito à anistia no primeiro momento da abertura governamental, e o agente de Estado, que cometeu crimes contra os direitos individuais e contra a humanidade teve o perdão garantido em decorrência da indeterminação constitutiva do texto da Lei. Palavras-chave: posição-sujeito, designação, equívoco, anistiado político, Lei da Anistia.Abstract: This work analyses, based on theoretical assumptions of French Discourse Analysis within the domain of the Pêcheutian French Discourse Analysis, how the promulgation of Law 6.683/79 (Brazilian Amnesty Law), which socially rules the condition of amnestied, establishes two types of subjects: the amnestied itself and, by opposition, the non-amnestied, from memory domains related to the designation amnestied. Once established, the amnestied subject is enounced from two subject positions: political amnestied and associated amnestied. The first is one that forgiveness is given for a crime committed against the State and the second is the associated amnestied, which definition ranges to the public agents. The not amnestied subject position evolves the subversive figure in which pre-constructed remits to one amnestied or to whom amnesty should be granted. However, the legal text, once submitted to the mistake order, which Pêcheux designated as the meaning's possibility to slide to different affiliations, denotes the opposite sense. It senses that the subversive individual did not have the right of amnesty at the beginning of the political opening, and the public agent, which committed crimes against both individual rights and Humanity, has had its forgiveness granted by de constitutive indetermination of the Law.
