O primeiro capítulo do trabalho contempla um estudo do instituto no direito norteamericano, que objetiva colher chaves interpretativas para melhor compreender o amicus curiae no direito brasileiro, em especial, desmistificando a ideia de neutralidade que o permeia. No segundo capítulo, investiga-se o interesse do amicus curiae e constrói-se a premissa de que o amicus curiae pode ser sujeito parcial, identificando-se os traços distintivos do amicus curiae e as principais diferenciações em relação às outras modalidades de intervenção de terceiros. Identificam-se, a partir da constatação de flexibilidade do instituto, as diferentes funções exercidas pelo amicus curiae. Propõe-se uma subcategorização do instituto a partir do critério do interesse e da proximidade em relação às partes e ao tribunal. O terceiro capítulo realiza um estudo dogmático do art. 138 do CPC/15, que regula o tema de forma geral, assim como dos demais dispositivos legais inseridos no Código que tratam do tema, abordando os pressupostos à intervenção, os poderes, o interesse recursal e as consequências da intervenção do amicus curiae. Por fim, o último capítulo analisa o amicus curiae à luz do papel participativo e legitimador que exerce no sistema de formação de precedentes vinculantes, a fim de suprir o déficit democrático, buscando identificar o tratamento procedimental adequado para permitir que o amicus curiae possa ter o máximo aproveitamento.Abstract: This dissertation investigates the amicus curiae in the Brazilian procedural law, consisting of a comprehensive study regarding its interest of intervention, functions, and legal framework. The first chapter of the work contemplates a study of the institute in American law, which aims to collect interpretive keys to better understand the amicus curiae in Brazilian law, demystifying the idea of neutrality that permeates it. In the second chapter, the interest of the amicus curiae is investigated, and the premise is constructed that the amicus curiae can be a partial subject, identifying the distinctive traits of the amicus curiae and the main differentiations in relation to other types of third-party interventions. Based on the observation of the institute's flexibility, different functions exercised by the amicus curiae are identified. A sub-categorization of the institute is proposed based on the criteria of interest and proximity to the parties and the court. The third chapter carries out a dogmatic study of Article 138 of the CPC/15, which regulates the subject in a general way, as well as the other legal provisions inserted in the Code that deal with the subject, addressing the assumptions of intervention, powers, appeal interest, and consequences of the intervention of the amicus curiae.
