Baseia-se numa perspectiva hermenêutica e semiológica como metodologia, vendo a Lei como um texto em que se reproduzem ideias, como representações sociais, que estão em vigor em determinadas sociedades e determinadas épocas. Trata primeiro dos conceitos de paisagem na geografia, desde as abordagens organicistas, positivistas do século XIX, até as abordagens funcionalistas e culturais a partir dos anos sessenta. Segue com a evolução da legislação ambiental e sua relação com a floresta, destacando as primeiras intenções econômicas e utilitárias dessa legislação no Brasil durante o século XVI-XVIII até os aspectos da propriedade privada, da nacionalização do bem da "natureza", o entendimento do interesse social na floresta e as influências do pensamento ambientalista e conservacionista. Discute, em seguida, quatro dimensões semióticas do Código Florestal: primeiro, os elementos individuais das florestas, a proteção e o gerenciamento destes; segundo, a garantia do funcionamento destes ecossistemas pela legislação, ambos em termos ecológicos como também em termos econômicos e sociais; terceiro, os aspectos interpretativos das florestas, como a questão da propriedade particular e do bem público, a ideologia do desenvolvimento sustentável e os aspectos simbólicos e estéticos desses ecossistemas. Aponta, finalmente, alguns problemas semióticos na aplicação do Código Florestal, como seu relacionamento com outros instrumentos legais, o problema da espacialização na proteção legal e a aplicação do Código em outros níveis hierárquicos da legislação ambiental, principalmente, no contexto estadual. Demonstramos, neste trabalho, que a legislação ambiental brasileira tem incorporado, a partir dos anos noventa, com sucesso, a perspectiva geossistêmica, tentando conciliar interesses sociais e ecológicos e direitos privados numa visão do desenvolvimento sustentável e modificando, assim, profundamente as antigas visões exclusivamente utilitárias. Cabe agora ao aparato jurídico e ao meio político implementar essa legislação respeitando as diferenças culturais da população contemplada.Abstract: This research discusses the landscape upon Peirce's semiotic on the Forestry Law of Brazil. It is based on a hermeneutic and semiotic approach, interpreting law as a specific social representation of a society in a certain time. First, it discusses the main geographical conceptions of landscape, since the initial organic and positivist ideas of the 19th century up to the functional and cultural approaches of landscape after Second World War. Then, it gives a resumed overview on the evolution of environmental law in Brazil, highlighting its economic and utilitarian aspects in 16th and 17th century Brazil, then appointing to the perspective of private property in the late Empire and the "Old Republic", continuing with the nationalization of the resource of "nature" during the Vargas period, and finally referring to the social aspect in democratic Brazil and the influence of environmentalist and conservationist ideologies. It then discusses four semiotic dimensions of the "Forestry Code": first, the individual elements of forests and their protection and utilization; secondly, the legal guarantee of the functioning of these ecosystems, both in ecological, and in economic and social perspective; thirdly, the interpretative aspects of forests, like the question of private property, the ideology of Sustainable Development and some symbolic and esthetic connotations of the landscape. Finally, it refers to some semiotic problems connected to the implementation of the "Forestry Code", like its relation to other legal instruments, the problem of spatial demarcation in environmental law, and its application in relation to other hierarchical legal levels, like State legislation. It could be shown throughout this research that - during the nineties - the environmental legislation of Brazil has successfully shifted to a geosystemical approach, which includes ecological, social and individual particular interests, combined in the vision of Sustainable Development and, thus, abolishing the predominant utilitarian aspect of the older legislation.
