Resumo: | This article deals with classical dichotomy which opposes natural law and positive law, adopting as objectives both present the contemporaneous terms of this debate as sustain a marxist critique of jusnaturalism and legal positivism. Despite the contrast between these two theories, they both abstract the material relations that provide historicity to law as a category that can not be reduced to generic notions of human good or authority. Legal subject’s perspective which is highlighted by Pashukanis offers a demonstration that law consists in the historically determinated form that social relations acquire in a society based on the generalized production of commodities. The core of the analysis is the necessary connection between legal form and commodity form, considering that both of them can only achieve its plain development in capitalism. This approach prevents conceptual embarassements like the idealization of law’s basic values that are supposed to be precedent in face of the singularity of material relations, or like the comprehension of legal categories as a mere volitive state creation. Pashukanis.Este artigo lida com a clássica dicotomia que opõe direito natural e direito positivo, adotando como objetivos tanto apresentar os termos contemporâneos desse debate como sustentar uma crítica marxista do jusnaturalismo e do positivismo jurídico. Apesar do contraste entre essas duas teorias, ambas abstraem as relações materiais que conferem historicidade ao direito enquanto categoria que não pode ser reduzida a noções genéricas de bem humano ou de autoridade. A perspectiva do sujeito de direito que é destacada por Pachukanis oferece uma demonstração de que o direito consiste na forma historicamente determinada que as relações sociais adquirem numa sociedade baseada na produção generalizada de mercadorias. O centro da análise é a conexão necessária entre a forma jurídica e a forma mercadoria, considerando que ambas só podem alcançar seu pleno desenvolvimento no capitalismo. Essa abordagem evita embaraços conceituais como a idealização de valores básicos do direito que pretendem anteceder a singularidade das relações materiais, ou como a compreensão das categorias jurídicas como mera criação volitiva do Estado.
