Resumo: This article reports analyses and conclusions formulated from comments about Brazilian Justice and that they had given to origin the thesis “Criminal Justice in Current Brazil: Democratic speech - practical authoritarian”.The objective of this research was, also, to reflect on the contemporary democracy, told by Boaventura de Souza Santos of representative elitist Such democracy, in evidence in Brazil soon after the opening politics occured in 1985, also adjusts the liberal project to it in course in the country and practically all the capitalist Ocidente.

O objetivo deste artigo é refletir sobre a democracia contemporânea e seu paradoxal convívio com o excesso de ordem. Mais do que simples convívio, observa-se a necessidade de subjugar o ideal democrático ao autoritarismo.
