Resumo: | The excessive fragmentation of the political parties in the Brazilian electoral system, allied with the ideological fragility of many of them, generates dysfunctions in the representative system and serious problems for the governability of the country. In this scenario, the inclusion of a performance clause in the legal framework of the country is a viable mechanism to assist in the resolution of these disorders. The issue is particularly highlighted by the recent constitution amendment proposal No. 36, which again seeks to implement a form of performance clause in the Brazilian legal system. Therefore, the present work aims to make a brief analysis of the provisions of the PEC (constitution amendment proposal), especially to confront the proposed text with the decisions of Direct Unconstitutional Actions (ADIs) Nos. 1,351-3 and 1,354-8, and ADIs No. 5.105. In the end, we conclude that, although salutary, the form brought by PEC 36 does not present itself as a better route to the end for which it is intended, especially since the Brazilian legislator insists on limiting access to the partisan fund and propaganda time which have already been declared unconstitutional by the Federal Supreme Court. |

Nesse cenário, a inclusão de uma cláusula de desempenho do arcabouço normativo jurídico pátrio apresenta-se como um mecanismo viável para auxiliar na resolução dos referidos distúrbios. O assunto ganha especial relevo com a recente Proposta de Ementa Constitucional n° 36, que novamente busca implementar uma forma de cláusula de desempenho no ordenamento jurídico brasileiro. Sendo assim, o presente trabalho tem como objetivo realizar uma breve análise sobre o disposto na referida PEC, especialmente para confrontar o texto proposto com as decisões das ADIs n° 1.351-3 e nº 1.354-8, e ADIs n° 5.105.
