Resumo: The objective of this research is to analyze the crime of sodomy from the representation in criminal proceedings and the judicial architecture that reveals the testimonies of social actors. The selected primary sources (criminal trials) reveal the sexual and love tensions that arise in the sociability between men. In none of the selected criminal cases, sodomy rape was reached, but they correspond to friendships, compadrazgos and commercial ties that the men developed in their daily lives and that, later, led to legal proceedings. The crime of sodomy in the Chile of the selected period was formally prosecuted by the national criminal law of 1874.

Las fuentes primarias seleccionadas (procesos criminales) develan las tensiones sexuales y amorosas que surgen en la sociabilidad entre varones. En ninguna de las causas criminales seleccionadas se llegó a la violación sodomítica, sino que corresponden a relaciones de amistad, compadrazgos y relaciones comerciales que los varones desarrollaron en su cotidianidad y que posteriormente se encuentran enfrentados a las leyes penales. El delito de sodomía en el Chile del periodo seleccionado era perseguido formalmente por el derecho penal nacional de 1874.O objetivo desta pesquisa é analisar o crime de sodomia a partir do representação no processo penal e a arquitetura judiciária que revela a depoimentos de atores sociais. As fontes primárias selecionadas (processos criminosos) revelam as tensões sexuais e amorosas que surgem na sociabilidade entre machos. Em nenhum dos casos criminais selecionados foi o estupro sodomítico, mas correspondem a relações de amizade, compadrazgos e vínculos comerciais que os homens desenvolveram em seu cotidiano e que, posteriormente, eles levaram a processos judiciais.
