A sucessão dos bens e contas digitais do autor da herança: análise do projeto de lei 75/2013

This article aims to elucidate if the current national legislation allows in the case of succession causes mortis the transmission of goods and digital accounts to the heirs of the de cujus, whether they are legitimate heirs or testamentary. Based on the Federal Constitution, Law of Succession, Federal Law No. 12,965 (Civil Registry of the Internet) and analysis of Bill 75/2013, checking the current procedures carried out by the supplier companies and contributing to put an end to the legal uncertainty that formed from the impasse of who would be the holder of the digital heritage. The study is justified by the fact that personal, professional and consumer relations become more and more virtual, information being concentrated in social networks and clouds not only the memories, photos, music, movies and books, but also documents, and -mails, passwords, electronic contracts, in this context the assets and digital accounts have economic, emotional and informative value, being necessary a legal approach on the digital inheritance.
