Currently, human rights are guaranteed by the Universal Declaration of Human Rights (1948). However, although there are disagreements among intellectuals about the beginning of the history of human rights, most agree that the Declaration of Human and Citizen Rights (1789), inaugurates the positivization of what we now understand as human rights, demonstrating the importance of this “Probable” first document about these universal ethical values that guides the legislation of many western countries, this document being our object of study. The Declaration and its rights, being one of the fruits of Modernity, need to be understood within its own time and space, and for that we will use the historical categories space of experience and horizon of expectations, developed by the German historian Reinhart Koselleck and analyzed in his work Future Past - Contribution to the semantics of historical times (1979).
