Resumo: The present essay deals with the involuntary hospitalization of people suffering from a mental disorder, a measure that do not respect the consent of the hospitalized individual regarding the applied procedure. The main objective of this dissertation is to analyze the unconstitutionality of involuntary hospitalization. The specific objectives are: to identify the terminologies, vulnerabilities, through the legislation perspective, and the recognition of people with mental disorders.; to draw contributions on psychiatric reform and the antiasylum struggle; and, finally, to explain the impasses of involuntary hospitalization based on national and international legislation. In tune with this investigative purpose, the research aimed specifically at discussing how the involuntary internment process affects the people submitted to it; and to that end, it dedicated to examining the hypervulnerability of people with mental disorders, through constitutional principles. In order to carry out the work, a quantitative methodology was used based on a bibliographic and documentary review with contributions from Law, Philosophy, Sociology and Health sciences, as well as a descriptive analysis. In this sense, the hypothesis is verified and it is concluded that involuntary hospitalization is unconstitutional.

Analisar a inconstitucionalidade da internação involuntária marca o objetivo central desta dissertação. Os objetivos específicos são: traçar aportes sobre a reforma psiquiátrica e a luta antimanicomial; levantar as terminologias, a vulnerabilidade, sob o olhar da legislação, e o reconhecimento das pessoas acometidas de transtorno mental; e, enfim, explicar os impasses da internação involuntária a partir da legislação nacional e internacional. Em observância a esse propósito investigativo, a pesquisa visou especificamente a discutir como o processo de internação involuntária afeta as pessoas a ela submetidas; e para tanto, dedicou-se, por meio dos princípios constitucionais, a examinar a hipervulnerabilidade das pessoas com transtornos mentais. Para a consecução do trabalho, foi utilizada uma metodologia quantitativa a partir de uma revisão bibliográfica e documental com aportes do Direito, da Filosofia e da Sociologia, assim como foi efetuada uma análise descritiva.
