Resumo: This study aims to analyze the working conditions of sugarcane cutters in the state of Alagoas and the state mechanisms to ensure the effectiveness of labor rights. Specifically, it seeks to understand the development of the sugarcane agroindustry and the work of the sugarcane cutter in Brazil and Alagoas; To know the actions of state agencies that act in the inspection and enforcement of the labor rights of this segment in the state of Alagoas; To identify how unions have taken action to defend the rights of these workers; And analyze how the working conditions and compliance with labor rights of sugarcane cutters are found in Alagoas, specifically those working in the mills located in the vicinity of Jequiá da Praia. It is a descriptive research, of the qualitative type, but also referred to in statistical data. It is anchored in the dialectical historical materialist method, which enables the apprehension of reality from its multiple determinations. It contemplated the following researches: a) bibliographical realized through books, periodicals, articles and specialized magazines; B) a documentary that occurred through the use of reports, newspaper reports, Terms of Adjustment and Conduct and labor legislation; C) and that of the field that occurred with interviews involving union leaders and sugarcane cutters. In the case of the unions, seven leaders were interviewed who were members of the rural workers' unions of Jequiá da Praia, São Miguel dos Campos, Murici, Atalaia, Paripueira, Ibateguara and União dos Palmares, all affiliated to the Federation of Agricultural Workers of Alagoas. The interviews were conducted during a meeting with the trade union leaders, in order to facilitate access to the interviewees, who were chosen based on the availability and interest in participating in the survey. On the other hand, interviews with sugarcane cutters were carried out in the municipality of Jequiá da Praia, chosen because it is located near several sugar mills and distilleries and, consequently, many sugarcane workers. For the interviewees' choice, the snowball method technique was used, reaching saturation point with 14 interviews. Snowball is an intentional, non-probabilistic type of sampling, used in social research in which the first participants of a study are responsible for indicating other respondents, and so on, successively until reaching the goal. We interviewed 14 sugarcane cutters who developed their activities between the years of 2008 and 2016. The main results pointed out that although there are state inspections, sugarcane cutters in Alagoas are still experiencing precarious working conditions. They are young workers who, although part of them have a formal contract, most companies disagree with labor rights. The working conditions are permeated by extensive and intense working hours, which can reach 14 hours a day; They receive by production, always with back pay and insufficient to maintain the family subsistence; Absence of workers in weighing and measuring sugarcane; Very poor condition of equipments for individual safety; Recurring occupational accidents and diseases; Problems with transportation, water, food and mobile toilets, among others. It was found that the presence of the union in labor matters is notorious and important, although many sugarcane cutters do not know well the work developed by the unions and criticize the actions developed by them.

De forma específica, procura compreender o desenvolvimento da agroindústria canavieira e o trabalho do cortador de cana no Brasil e em Alagoas; conhecer a atuação de órgãos estatais que agem na fiscalização e cumprimento dos direitos trabalhistas desse segmento no estado de Alagoas; identificar como tem ocorrido a atuação dos sindicatos na defesa dos direitos desses trabalhadores; e analisar como se encontram as condições de trabalho e o cumprimento dos direitos trabalhistas dos cortadores de cana em Alagoas, especificamente daqueles que desenvolvem atividades nas usinas que se localizam nas adjacências de Jequiá da Praia. Trata-se de uma pesquisa de caráter descritivo, do tipo qualitativa, mas que também se referencia em dados estatísticos. Está ancorada no método materialista histórico dialético, que possibilita a apreensão da realidade a partir das suas múltiplas determinações. Contemplou as seguintes pesquisas: a) bibliográfica realizada através de livros, periódicos, artigos e revistas especializadas; b) a documental que ocorreu por meio da utilização de relatórios, reportagens de jornais, Termos de Ajustamento e Conduta e legislações trabalhistas; c) e a de campo que se deu com a realização de entrevistas envolvendo líderes sindicais e cortadores de cana. No caso dos sindicatos, foram entrevistados 07 dirigentes que faziam parte dos sindicatos dos trabalhadores rurais de Jequiá da Praia, São Miguel dos Campos, Murici, Atalaia, Paripueira, Ibateguara e União dos Palmares, todos filiados à Federação dos Trabalhadores da Agricultura de Alagoas. As entrevistas foram realizadas durante uma reunião com as lideranças sindicais, de forma a facilitar o acesso aos entrevistados, que foram escolhidos a partir da disponibilidade e interesse em participar da pesquisa. Já as entrevistas com os cortadores de cana foram feitas no município de Jequiá da Praia, escolhido pelo fato de estar localizado próximo a várias usinas/destilarias e, consequentemente, agregar muitos trabalhadores que vivem do corte da cana. Para a escolha dos entrevistados foi utilizada a técnica metodológica Bola de Neve que chegou ao ponto de saturação com 14 entrevistas. Bola de Neve é uma forma de amostragem do tipo intencional não probabilística, usada em pesquisas de caráter social em que os primeiros participantes de um estudo são os responsáveis por indicar outros entrevistados, e assim, sucessivamente, até atingir o objetivo. Foram entrevistados 14 cortadores de cana que desenvolveram suas atividades entre os anos de 2008 e 2016. Os principais resultados apontaram que apesar de haver fiscalizações estatais, os cortadores de cana em Alagoas ainda estão vivenciando condições de trabalho precárias. São trabalhadores jovens que apesar de parte deles possuir carteira de trabalho assinada, a maioria das empresas descumpre os direitos trabalhistas. As condições de trabalho são permeadas por extensas e intensas jornadas de trabalho, que podem chegar a 14 horas diárias; recebem por produção, sempre com salários atrasados e insuficientes para manter a subsistência familiar; ausência do trabalhador na pesagem e medição da cana; péssimo estado de conservação dos EPI‘s; recorrentes acidentes de trabalho e doenças ocupacionais; problemas com o transporte, água, alimentação e banheiros móveis, dentre outros.
