The attribution of abstract and concrete meanings by hermeneutics to democratic institutions is in favor of the sovereignty of the people, so that political participation in matters of local interest can reveal the degree of citizenship of a society. Freedom of expression, as a fundamental right of the human person, is one of the pillars of the Democratic State of Law itself and includes freedom of thought, opinion and communication. It will be examined the capture of votes for the purpose of forming the popular will, in order to substantiate a critical analysis on the establishment of rules for the mass media, on the grounds that such information vehicles could compromise the maximum equality of the electoral contest. The objective of this dissertation is to investigate the collision of fundamental rights intrinsically related to the electoral period, as well as to demonstrate attempts to give rationality to the means of control of eventual judicial decision in this matter. The methodology will be limited to the normative analysis of the matter, besides the foundations and conclusions expounded in specific judgments, like the Representation n. 165.865/TSE. Finally, the following hypotheses will be presented: the possibility of restricting the norms related to electoral propaganda in favor of the equality between the candidates and the smoothness of the lawsuit; the adequacy of electoral propaganda to its primary function, namely, to bring concrete proposals and government programs to the attention of the electorate, without entering the field of personal offenses against the competing candidate; the appreciation of the public interest to resolve the conflict between the right to the image of the candidate and the right to information of the voter.
