Resumo: This essay pretends to analyze the use of Stop and Frisk in a racialized way, centered on black young people from Aracaju, facing a scenario wherein Sergipe’s state has the fourth highest mortality rate in police interventions. Thereby, the study aims to investigate the racial relationship of this acting, as well as the institutional racism’s influence on it and the black youth’s perception about this posible relation. For this purpose, the essay produces a analysis about the Stop and Frisk’s construction by founded suspicion, current at the art. 244, of the Criminal Procedural Code and how the institutional racism present in the Corporation influences in your definition. Besides, it discusses the association of black young people to a potential suspect, visualizing them as the State’s enemy. Also, the essay examines how the racialized stop and frisk is used as a death politic’s tool, exploring brief notions concerning necropolitics and black people’s genocide. Finally, it performs a focal group in search of understand the perception of black youth (target population), regarding police acts. The metodology started with bibliographic research, as from Sinhoretto’s (2014) and Anunciação (2020) studies, as well as theory of enemy’s criminal law by Jakobs (2012) and Zaffaroni (2011) and necropolitic notions by Mbembe (2019). Futhermore, focal group’s metodology was used to colect data that was treated from inspiration by the Data Grounded Theory. The essay concludes existence of a racialized stop and frisk that has a impact in life’s quality of black people from Aracaju, mainly black young men, as the racial relationship which views them as danger. Therefore, it points to a maintenance of black men as potential suspect that is made and funded by the system that run through its vision over to their agents over institutional racism.

Dessa forma, objetiva-se investigar a relação racial deste fenômeno, assim como a influência do racismo institucional nele e a percepção da juventude negra sobre essa possível relação. Para este propósito, o trabalho realiza um estudo sobre a construção da abordagem policial pela fundada suspeita, vigente no art. 244, do Código Processual Penal e como o racismo institucional presente na corporação influencia em sua definição. Além disso, examina-se a associação da imagem do jovem negro a um potencial suspeito, visualizando-o como inimigo do Estado. O trabalho também averigua como a abordagem policial racializada é usada enquanto ferramenta da política de morte, versando breves noções acerca da necropolítica e do genocídio da população negra. Por fim, realizou-se um grupo focal em busca de compreender a percepção da juventude negra (população-alvo) a respeito das ações policiais. A metodologia usada se iniciou com a pesquisa bibliográfica, a partir dos estudos de Sinhoretto (2014) e Anunciação (2020), assim como a teoria do direito penal do inimigo de Jakobs (2012) e Zaffaroni (2011) e a noção de necropolítica de Mbembe (2019). Outrossim, utilizou-se a metodologia do grupo focal para colher os dados necessários que foram tratados a partir de inspiração na Teoria Fundamentada nos Dados. O trabalho conclui pela existência de uma abordagem policial racializada que tem um impacto direto na qualidade de vida da população negra aracajuana, principalmente aos homens jovens, assim como uma relação racial que visualiza essas pessoas como um perigo.
