Resumo: The main objective of this paper is demonstrating that human rights treats that Brazil has ratified enter injuridical domestic system with constitutional normative force, as amendments to the Constitution were,strengthening the compromise from the Political Charter to development. This is due to a broad andsystematic interpretation of the 5th. article, §2º of the Federal Constitution, in search of greater efficiencyof the constitution text. From this combination between International Law and the Public domestic Law itis possible to draw a real hermeneutic of human rights with a double dimension: the domestic and theinternational sphere, both of them are essential to face the contemporaneous challenges to development.Finally, adopting a critical perspective of human rights we show that there is a complex relation betweendevelopment and the full respect of human rights, emphasizing the economic, social and cultural rights.

O principal objetivo deste trabalho é demonstrar que os tratados internacionais de direitos humanos dosquais o Brasil é parte, ingressam no ordenamento jurídico interno com força normativa constitucional, comose emendas ao texto constitucional fossem, reforçando o compromisso assumido pela Carta Política com odesenvolvimento. Isto se depreende de uma interpretação ampla e sistemática do artigo 5º, §2º daConstituição Federal de 1988, em busca de conferir a maior eficácia possível à Constituição. Destaconfluência entre o direito internacional e o direito público interno configura-se uma verdadeirahermenêutica de direitos humanos que articula as duas dimensões de proteção: a esfera doméstica e ainternacional, ambas essenciais em vista dos desafios contemporâneos colocados ao desenvolvimento.Adotando, por fim, uma perspectiva crítica dos direitos humanos, assinala-se a intrincada relação entredesenvolvimento e pleno respeito aos direitos humanos, com especial ênfase aos direitos econômicos,sociais e culturais (DESC).
