Water market: how it happened in the usa and how it can happen in Brazil

Resumo: The article discusses the potential water market issue in Brazil. As it is unused, first the US case is presented, probably the oldest and the most documented one, in which during the 19th Century, the water exploration rights were transformed into property rights to deal with shortage problems, and in the last 20 years its commerce has been intensified in the face of the droughts’ aggravation. In Brazil, a similar idea is being presented by the National Congress, and it seems to have echoed in federal government sectors, despite its incompatibility with the constitutional principle that waters constitute public domain assets of the Union and of the States.

Como el asunto es insólito, primero se presenta el caso de los EE.UU., probablemente el más antiguo y bien documentado, donde en el siglo XIX las concesiones de explotación de agua recibieron derechos de propiedad para lidiar con problemas de escasez, y en los últimos 20 años el comercio se intensificó frente al agravamiento de las sequías. En Brasil algo similar está propuesto en el Congreso Nacional, y parece encontrar eco en sectores del gobierno federal, a pesar de su incompatibilidad con el principio constitucional de que las aguas constituyen bienes de dominio público del Estado Nacional y de los Estados.O artigo discute a questão de um potencial mercado de água no Brasil. Como o assunto é insólito, primeiro se apresenta o caso dos EUA, provavelmente o mais antigo e bem documentado, onde no Século XIX as outorgas de exploração de água receberam direitos de propriedade para se lidar com problemas de escassez, e nos últimos 20 anos seu comércio se intensificou em face ao agravamento das secas.
