From secret sessions to the “indecent transparency” of the open doors: an introduction to Brazilian Constitutional History

Resumo: | This paper aims to produce an archeology of the category “open doors” and, consequently, to present elements capable of facilitating the comprehension about the exercise of collegiality in the Brazilian Courts. To do this, a historical research was produced from the consultation of the annals of the Brazilian Parliament from 1826 to 1828, laws and ordinances before and after the indicated period, in addition to bibliographic analysis about this. As a result, in addition to the demonstration of tensions between the State Powers, two important moments are presented to understand the format of the trial sessions in the Courts: the beginning (i) of a “Brazilian constitutionalism” and (ii) of the autonomy of the Brazilian Courts. The demarcation of these moments allowed us to understand how, in a little less than two hundred years of Brazilian Constitutional History, the Courts migrated from a format in which (i) they discussed and deliberated with the closed doors, moving to a mixed system in which they discussed in Secret Sessions and deliberated with the open doors for (iii) a system in which they discuss and deliberate with the open doors (i) they discussed and deliberated with the closed doors, moving to a mixed system in which they discussed in Secret Sessions and deliberated with the open doors for (iii) a system in which they discuss and deliberate with the open doors. |

Para tanto, foi produzida uma pesquisa historiográfica a partir da consulta aos anais do parlamento brasileiro de 1826 a 1828, leis e ordenanças anteriores e posteriores ao período indicado, além de análise bibliográfica sobre o tema. Como resultados, além da demonstração de tensões entre os Poderes de Estado, são apresentados dois importantes momentos para compreender o formato das sessões de julgamento nos tribunais: (i) o início de um “constitucionalismo brasileiro” e (ii) o processo de autonomização administrativa dos tribunais brasileiros.
