Examines the current Brazilian legislation about archives of science. The methodology is qualitative, descriptive and explanatory. The procedures used are the bibliographic survey and legislation relevant to the subject. As a result, chronologically, it was verified in brazilian archival legislation the first concern to protect public property. After the redemocratization of the country, and, subsequent promulgation of the Law on Access to Information (LAI), there is mobilization in granting access to public archives, which includes archives of science. As for these, so far, only a very specific normative was found, related to access to the medical records of patients, of a specific institution. And, punctually, in the Law General on The Protection of Private Data, issues related to data protection in scientific research. It was also found that the legislation does not have a clear distinction between public and private archives, which reflects the difficulty in differentiating files from science institutions and private archives from scientists. With regard to the privatecollections declared in the public interest, there is no clarity as to the criteria of definition. Therefore, in Brazil, legislation on science archives is still insufficient and its conception is necessary to support the development of science.
