Resumo: This article intends to discuss the crisis of contemporary democracy, a theme whose protagonism has permeated, for decades, academic debates in the most varied fields of scientific knowledge. However, given the multiple diagnoses about its causes, as well as the need to give theoretical depth to the research, it was decided to examine only two of it, admittedly harmful to the stability of Rules of Law: a) the populism, which has been strengthened in recent years due to the escalation of movements linked to the extreme right in Europe ans Latin America; and b) the confusion between public and private powers, allied to the effects of its connection with oligopolies that own large media conglomerates. After carrying out the investigation, according to the assumptions of the hypothetical-deductive methodology and the bibliographic review technique, it was possible to conclude that both analyzed phenomena constitute institutional anomalies, which contribute to the rupture of the legal order and compromise the classic separation between State and society.

Universidade Federal de Santa Catarina2023-08-28info:eu-repo/semantics/articleinfo:eu-repo/semantics/publishedVersionapplication/pdfhttps://periodicos.ufsc.br/index.php/sequencia/article/view/9316610.5007/2177-7055.2023.e93166Seqüência - Legal and Political Studies; Vol. 44 No. 93 (2023): Seqüência - Estudos Jurídicos e Políticos; 1-21Revista Seqüência: Estudos Jurídicos e Políticos; Vol. 44 Núm. 93 (2023): Seqüência - Estudos Jurídicos e Políticos; 1-21Seqüência Estudos Jurídicos e Políticos; v. 44 n. 93 (2023): Seqüência - Estudos Jurídicos e Políticos; 1-212177-70550101-9562reponame:Sequência (Florianópolis.
