Resumo: The aim of this paper is to examine the environmental civil liability on the Brazilian jurisdiction and it’s transformations trying to adequate to the necessities of prevention and precaution, considering the environmental risks. Firstly, the liability principle is introduced to discuss the Brazilian environmental issues. After that, the possibility of implicating the strict liability is also observed because of it relation with the reparation of the environmental damages. In addition, an analysis of the environmental risks, the precautionary, the prevention and the polluter pays (PPP) principles is provide, intending to improve the implementation of the environmental civil liability.

Posteriormente, a possibilidade de aplicação da responsabilidade objetiva é também observada, devido à sua relação com a reparação dos danos ambientais.
