Direito.O presente trabalho busca fazer uma análise da pirataria na atual conjuntura tecnológica, a Era da Informação, e a sua adequação no ordenamento jurídico, seja no âmbito civil que penal. Para isso, foram definidos os conceitos de Direitos Autorais, propriedade intelectual, pirataria e Era da Informação. Em seguida, foi realizada uma extensa pesquisa das diversas indústrias envolvidas na produção de conteúdo protegido pelos Direitos Autorais para verificar a transição do meio físico, ou analógico, para o virtual. Consequentemente, elaborou-se pesquisa no sentido de identificar se a pirataria seguiu nesse mesmo trajeto de digitalização. Posteriormente, realizou-se uma análise e interpretação dos dados coletados e a sua relação com a legislação contemporânea, em especial a tipificação penal do crime de violação de direito de autor. Foi, então, verificada a adequação de tal legislação para lidar com as transformações tecnológicas das últimas décadas e as novas expectativas sociais dessa evolução. Por fim, conclui-se que as novas tecnologias possibilitaram a emergência de um novo modelo de negócio, exigindo, portanto, uma nova legislação, mais adequada e constitucional. Acesso.The present work aims to make an analysis of piracy in the current technological conjuncture, the Information Age, and its adequacy in the legal system, be it civil or criminal. For this, the present work defined the concepts of Author Rights (copyright), intellectual property, piracy and Information Age. Subsequently, the study conducted an extensive survey of the various industries involved in the production of copyrighted content to verify the transition from the physical, or analog, medium to the virtual. Consequently, this work conducted the same kind of research to identify whether piracy followed this same path of digitization. Subsequently, this project analyzed and interpreted the data collected and its connection with contemporary legislation, in particular the criminalization of copyright infringement. This work then verified whether such legislation is able to deal with the technological changes of the last few decades and the new social expectations of this evolution. Finally, it has been concluded that the new technologies have enabled the emergence of a new business model, therefore requiring a new, more adequate and constitutional legislation.
