Direito.Este trabalho tem por objetivo investigar se o testamento particular gravado em sistema audiovisual pode trazer benefícios ao direito sucessório e à sociedade a ponto de justificar uma reformulação na Seção IV do Capítulo III no Livro de Sucessões do Código Civil de 2002. A relevância da pesquisa se traduz no fato de que o assunto é inovador e necessário, uma vez que não há como negar o impacto tecnológico no meio jurídico; principalmente com a pandemia da COVID-19. Com a finalidade de se alcançar o objetivo principal, o trabalho tem os seguintes objetivos específicos: conceituar testamento em geral, as suas formas, as suas validades e as suas especificidades, a fim de melhor elucidação dos termos jurídicos; comparar o testamento particular do Código Civil vigente com o disposto no Código Civil de 1916, com o propósito de identificar as alterações trazidas e de compreender se foram significativas para a evolução do direito sucessório; investigar uma parte do Projeto de Lei n° 3.799/19, idealizado pelo Instituto Brasileiro de Direito de Família (IBDFAM), que aborda o uso de meio audiovisual no testamento particular, no intuito de verificar a necessidade de atualização testamentária para o contexto de uma sociedade tecnológica; relatar julgados referentes ao testamento particular, com a finalidade de investigar se há certa flexibilização das formalidades constantes no Código Civil, com a incorporação tecnológica, ainda que de forma ínfima; e identificar pontos negativos e positivos da feitura do testamento particular por meio de audiovisual. Dito isso, o primeiro capítulo aborda o motivo do testamento ser considerado um tabu, o seu conceito, as suas formas, as suas validades e as suas especificidades, além de entender o que é capacidade de testar e de adquirir testamento. O segundo capítulo se dedica ao testamento particular propriamente dito: examina seus requisitos, suas formalidades e seu processo de confirmação em juízo, além de realizar uma comparação entre o testamento particular do Código Civil vigente e o do Código Civil de 1916. O último capítulo trata do impulso da tecnologia no direito sucessório e seus reflexos no testamento particular. Em função disso, explana sobre os três últimos objetivos específicos. Após esse estudo, o trabalho entende que o testamento particular em vídeo pode trazer benefícios ao direito sucessório e à sociedade a ponto de justificar a reformulação na seção que trata do testamento particular.This work aims to investigate whether the private will recorded in the audiovisual system can bring benefits to the succession rights and to society to the point of justifying a reformulation in Section IV of Chapter III in the Book of Successions of the Brazilian Civil Code of 2002. The relevance of the research consists into the fact that the subject is innovative and necessary since there is no way to deny the technological impact on the legal environment; mainly with the COVID-19 pandemic. In order to achieve the main objective, the work has the following specific objectives: to conceptualize a testament in general, its forms, its validities and its specificities, in order to better elucidate the legal terms; compare the current holographic will of the Brazilian Civil Code with the holographic will of the Brazilian Civil Code of 1916, in order to identify the changes brought about and to understand whether they were significant for the evolution of Brazilian inheritance law; investigate part of Bill n° 3.799/19, designed by the Brazilian Institute of Family Law (IBDFAM), which addresses the use of audiovisual media in the private will, in order to verify the need for testamentary updating for the context of a technological society; report judgments referring to the holographic will, with the purpose of investigating if there is a certain flexibility in the formalities contained in the Brazilian Civil Code, with the technological incorporation, even if in a very small way; and to identify negative and positive points of the making of the holographic will recorded in an audiovisual system. That said, the first chapter deals why a will is considered taboo, its concept, its forms, its validities, and its specificities, in addition to explaining about the testamentary capacity: writing and testate successor. The second chapter is dedicated to the holographic will itself: it examines its requirements, its formalities, and its process of confirmation in court, in addition to making a comparison between the holographic will of the current Brazilian Civil Code and that of the Civil Code of 1916. The last chapter deals with the impulse of technology in Brazilian Inheritance Law and its reflexes in the holographic will. As a result, explains about the last three specific objectives.
