Para tal fim a pesquisa parte do contexto político, social e institucional da República tardia, enfatizando a competição existente entre juristas e oradores dentro da nobilitas, servindo-se para tal, em particular, dos tratados retóricos e das orações de Marco Túlio Cícero. Por meio da narrativa histórica criada através das fontes latinas disponíveis, e, lançando mão de pesquisa bibliográfica e discussões historiográficas, o trabalho delineia uma distinção entre certo modelo de jurista vigente na República tardia, chamando-o de ?juristas de transição?, e o jurisconsulto especializado e centralizado no conhecimento do ius que se forma a partir do governo de Augusto, que caracteriza dali em diante o jurista do Principado. A mudança se configura pelo locus social e político dos juristas que, em tempos republicanos, e, ainda na República tardia, disputavam com os demais membros da nobilitas pela governança da res publica, passando, após o período dos triunviratos, a atuar em referência ao novo contexto institucional desenhado por Augusto. A temporalidade da figura dos jurisconsultos não está absolutamente ligada ao regime político e institucional, mas, com ele se entrelaça. Os dois juristas de transição analisados são Caio Aquílio Galo e Sérvio Sulpício Rufo, também homens públicos que, tendo conhecido Quinto Múcio Cévola Pontífice e se servindo da tradição do ius civile por ele representada, outrossim possuem também marcas de uma nova estirpe de jurista, tendente cada vez mais à especialização ou setorização, guardando características do velho modelo do jurisconsulto republicano, mas também alçando o novo. Por meio de uma análise de outros três juristas que se formaram no contexto republicano ? Aulo Ofílio, Trebácio Testa, Alfeno Varo ? e dois que constroem suas carreiras ao longo de Augusto ? Ateio Capitão e Antístio Labeão ?, a obra destrinça a mudança no lugar social e político do jurista a partir do começo do Principado e sua relação com o ius respondendi, a aliança e amizade do princeps e as mudanças no funcionamento do cursus honorum.<br>Abstract : To understand the formation and the rise of the classic roman iurisconsultus, but without resorting only to abstract explanatory schemes, this work brings special attention specific and documented trajectories of the jurists between the last century BC and the Augustan period. To this end the dissertation begins with the political, social and institutional context of the Late Roman Republic, emphasizing on the competition between the jurists and the orators of the nobilitas, and with special regard to the rhetorical treatises and the discourses of Marcus Tullius Cicero about this issue. Through the historical narrative created by the exam of the sources and the historiographical discussions about the matter, the work draws a distinction between the jurist model of the Late Republic, calling it ?transitional jurists?, and a specialized kind of jurist that rise between Augustus? government and the Principate. This change is set by the political and social locus of the roman jurists. In the republican times, even in the late Republic, the jurists contended the governance of the res publica with other members of the nobilitas and, after the period of the triumvirates, began to act in reference to the new institutional framework of the Augustan age. The temporality of the figure of jurists is not inextricably linked to the political and institutional regime, but with it crosses. There are two transitional jurists analysed in this work. They are Caius Aquillius Gallus and Servius Sulpicius Rufus, not only jurisconsults, but also public men who have know Quintus Mucius Scaevola Pontifex and have served themselves of the ius civile tradition represented by him. Likewise, the two jurists also represent a new kind or model of jurist, with great tendency to specialization to their jurist knowledge, so, keeping features of both old republican jurist model and the new one. By an analysis of the three other jurists who have formed themselves in the republican context ?Aulus Ofilius, Trebacius Testa and Alfenus Varus ? and of the two famous jurists who have built their careers along Augustus ?
