Direito.A presente monografia objetiva analisar se o Estado, à luz da legislação processual vigente brasileira, possui legitimidade para ser o beneficiário dos valores resultantes da aplicação das multas coercitivas, impostas para garantir o cumprimento das tutelas específicas.As obrigações específicas, ou seja, aquelas que dependam de um fazer, não fazer ou entregar coisa distinta de dinheiro, sempre foram relegadas na órbita processual, notadamente porque o direito processual residia afastado do plano material. A conversão das obrigações específicas descumpridas em perdas e danos era quase automática, em vista da estimulação que se oferecia para tanto. A partir da verificação da inaptidão do sistema processual, que era incapaz de tutelar as obrigações específicas, o legislador alterou significativamente o Código de Processo Civil. Com as reformas iniciadas na década de 90, positivou uma série de mecanismos tendentes a efetivar o direito material. Dentre eles, existe a multa coercitiva, que é o instrumento mais difundido e utilizado para garantir a autoridade do mandamento jurisdicional e para compelir o devedor a cumprir a obrigação assumida, com a consequente concessão ao credor da exata prestação que ele obteria. O crédito decorrente da aplicação da medida, que dependendo da mora no cumprimento da obrigação pode se tornar colossal, estranhamente, é destinado ao próprio credor, que se enriquece sem causa, justamente porque nada fez para aumentar o seu patrimônio. Assim, necessário analisar-se criticamente essa prescrição, para que se constate se o beneficiário dos valores realmente deve ser o credor, e não o Estado.This monograph aims to analyze whether the state, in light of the procedural legislation in force in Brazil, has standing to be the beneficiary of values resulting from the application of coercive fines imposed to ensure compliance with the specific tutelage. Specific obligations, those for which a do, not do or deliver anything other than money, have always been relegated in orbit procedural, notably because the procedural law resided away from the material. The conversion of specific obligations unfulfilled in damages was almost automatic, in view of the stimulation that is offered to both. With the reforms launched in the 90s, initiated a number of mechanisms to accomplish the right stuff. Among them, there is a coercive fine, which is the most widespread and used for maintaining the authority and jurisdiction of the commandment to compel the debtor to fulfill the obligation assumed, with the consequent granting the lender the exact provision that he would get. The credit arising from the application of the measure, depending on the delay in performance of the obligation can become colossal, eerily, is destined to own lender who is unjustly enriched, precisely because it did nothing to increase your net worth.
