Direito.O presente trabalho pretende identificar os elementos que fundamentam o controle penal da loucura no contexto atual da sociedade brasileira, bem como denunciar a invisibilidade na qual estão submersos os sujeitos com sofrimento psíquico em conflito com a lei. Foram recuperados conceitos essenciais da história da psiquiatria e do positivismo criminológico com o intuito de verificar como estes relacionam-se à trajetória da aplicação da medida de segurança e como fundamentam as práticas de internação no âmbito do sistema penal. O comportamento criminoso é visto como sintoma da periculosidade, justificando providências preventivas de tratamento ambulatorial e de internação em hospital de custódia por tempo indeterminado. Apesar de vedar expressamente a internação com características asilares, a Lei da Reforma Psiquiátrica (Lei nº 10.216/01) ainda não foi recepcionada em sua integralidade pelo direito penal. As considerações finais desse trabalho são no sentido de que as formulações criminológicas positivistas, arraigadas na sistemática normativa da medida de segurança, não podem ser superadas por meio de interpretações e adaptações normativas e exigem uma mudança paradigmática.This study intends to identify the elements that motivate the criminal control of insanity in the current context of brazilian society, as well as denounce the invisibility in which the subjects with psychic suffering in conflict with the law are submerged. Essential concepts of the history of psychiatry and criminological positivism were resumed in order to verify how they relate to the trajectory of the application of the security measure and how they are based on the internment practices within the criminal system. The criminal behavior is seen as a symptom of dangerousness, justifying preventive measures of outpatient treatment and hospitalization in a custody hospital. Although it expressly prohibits hospitalization with asylum characteristics, the Law of Psychiatric has not yet been fully approved by criminal law.
