Academic archive of the institutions of education belonging to the federal system of education: maintenance, guard and conversion for the digital medium under brazilian legislation

In 2017, the Brazilian government published two legal provisions aimed at managing the academic archives of the undergraduate and postgraduate courses of the higher education institutions (IES) belonging to the federal education system: Decree 9.235 of 15 of december 2017 and Ordinance 22 of the Ministry of Education (MEC) of december 21, 2017. In 2018 this ordinance was revoked by Administrative Rule 315 MEC, of april 4, 2018, published in parallel with Ordinance 330 MEC, of April 5, 2018, which provides for the issuance of diplomas in digital format. The research focuses on the regulatory trajectory and the procedures for maintenance, custody and conversion of the academic content of institutions of higher education belonging to the federal education system for the digital environment, through the counterpoint of MEC regulations with national archival legislation, especially the recommendations issued by the National Archives Council (Conarq). In this sense, it is verified that the Brazilian government has been encouraging the computerization of academic archives through the digitization of documents, and also through the production of digital born documents, as in the case of digital diploma issuance and related documentation. Thus, it is considered that institutions of higher education should implement management policies for archival documents and observe the other legislation, especially Conarq guidelines and recommendations, which were not included in the recent regulations of the academic archives, so that the production and preservation of documents are legally protected and accessible in the long term.
