THE COOPERATIVE PROCESS AS A PRADAIGM FOR THE REDIMENSIONING OF THE JUDGE’S ACTIVITY AND THE OVERCOMING OF HARMFUL PRACTICES OF JUDICIAL ACTIVISM: THE APPLICATION OF THE NEW MODEL DECISION BY THE SUPERIOR COURT OF JUSTICE

Resumo: The paper analyzes the structural changes in the study and design of civil procedural science, in order to highlight the deviations that have occurred in our country that led to the increase of judicial protagonism and the need to build a new process paradigm to combat harmful practices judicial activism. Using as a methodological option bibliographical research and the jurisprudence of the Superior Court of Justice, we start with the study of neoconstitutionalism, as a theoretical framework decisive for structural changes in procedural science, which, in our country, ended up generating a judicial role. The following is an analysis of the search for a new procedural model capable of overcoming judicial activism. It is concluded, with support in the most recent judgments of the Superior Court of Justice, that the cooperative process model, provoking a paradigm shift and resizing in the role of the judge, has proven to be effective in combating the harmful practices of activism practiced by some judges.

Utilizando la investigación bibliográfica y la jurisprudencia de la Corte Superior de Justicia como opción metodológica, partimos del estudio del neoconstitucionalismo como marco teórico decisivo para los cambios estructurales de la ciencia procesal, que, en nuestro país, terminaron generando un rol judicial. A continuación, se analiza la búsqueda de un nuevo modelo procesal capaz de superar el activismo judicial. Se concluye, sustentado en las más recientes sentencias de la Corte Superior de Justicia, que el modelo de proceso cooperativo, provocando un cambio de paradigma y un redimensionamiento del rol del juez, ha demostrado ser efectivo en el combate a las prácticas nocivas del activismo practicado por algunos jueces.O trabalho analisa as mudanças estruturais no estudo e no dimensionamento da ciência processual civil, para salientar os desvios ocorridos em nosso país que levaram ao incremento do protagonismo judicial e à necessidade de construção de um novo paradigma de processo para superar as práticas nocivas do ativismo judicial. Utilizando-se como opção metodológica a pesquisa bibliográfica e a jurisprudência do Superior Tribunal de Justiça, parte-se do estudo do neoconstitucionalismo como marco teórico decisivo para as mudanças estruturais da ciência processual, o qual, em nosso país, acabou gerando um protagonismo judicial. A seguir, analisa-se a busca de um novo modelo processual capaz de superar o ativismo judicial.
