Resumo: This paper aims to relate a panorama of compliance that companies are put into from directives of General Law of Personal Data Protection. The research is developed from the presentation of theoretical concepts and appliances of compliance policies for the corporation scope, followed by a study of Law 13.709/2018, of scientific papers regarding the theme and Brazilian Civil Law theory for grounding of regulation adjustment analysis for companies in their size variation, structure and business characteristics. The results indicate challenges not only for law effectiveness, due to its own complexity, but also for private institutions for its technical and administrative issues concerning corporate governance. Such challenges present as a gap for effectiveness of law over fact reality, and pointing out to customized law consulting according to the characteristics of business as compliance.

La investigación se realiza desde la presentación de los conceptos y aplicaciones de las políticas de cumplimiento para el ámbito empresarial, seguida de un estudio de la Ley 13.709/2018, de artículos científicos que tocan el tema y la doctrina del Derecho Civil brasileño para apoyar el ajuste. Análisis normativo para las empresas, en sus variaciones de tamaño, estructura y características de negocio. Los resultados de la investigación señalan la dificultad encontrada no solo para el alcance de la vigencia de la ley, dada su complejidad inherente, sino también para las entidades de derecho privado, por cuestiones técnicas y administrativas de gobierno corporativo. Dichos desafíos se presentan como un vacío en la efectividad de la regla sobre la realidad fáctica, apuntando a una asesoría legal a la medida de las características del negocio como un esfuerzo por adaptarse a las reglas.O presente trabalho busca relacionar um panorama das adequações normativas as quais as organizações estão sujeitas a partir das diretrizes firmadas pela Lei Geral de Proteção de Dados Pessoais. A pesquisa é realizada a partir da apresentação dos conceitos e aplicações de políticas de compliance para o âmbito corporativo, seguido por um estudo da Lei 13.709/2018, de artigos científicos que tocam o tema e da doutrina de Direito Civil Brasileiro para fundamentação das análises de ajuste normativo para as empresas, em suas variações de porte, estrutura e características de negócio. Os resultados da pesquisa indicam a dificuldade encontrada não somente para âmbito de efetividade da lei, dada sua complexidade inerente, mas também para as entidades de direito privado, em razão de questões técnicas e administrativas concernentes à governança corporativa.
