CONSIDERATIONS ON INJUSTIFIED ENRICHMENT IN ADMINISTRATIVE LAW

Resumo: Unjust enrichment can be conceptualized as the increase of assets that occurs in the subject's assets, to the detriment of others, without having any legal basis for this. Thus, it can be said that its proscription in the legal system constitutes a general principle of law. Nevertheless, it should be noted that the rules on unjust enrichment are not exclusively applicable to relations between individuals, but extend to the spheres of public law. This study is presented in the form of a bibliographical research that aims to discuss the subject of unjust enrichment in Administrative Law, having as a theoretical contribution doctrines and jurisprudence related to the theme in order to elucidate the cases of configuration and not configuration of unjust enrichment within the Public Administration.

Así, se puede decir que su proscripción en el ordenamiento jurídico se constituye en un principio general del derecho. No obstante, hay que observar que las reglas sobre el enriquecimiento sin causa no son exclusivamente aplicables a las relaciones entre individuos, sino que se extienden a las esferas de derecho público. Este estudio se presenta en la forma de una investigación bibliográfica que busca debatir el tema del enriquecimiento injusto en el Derecho Administrativo, teniendo como aporte teórico doctrinas y jurisprudencia relativas al tema con el fin de elucidar los casos de configuración y no configuración del enriquecimiento sin causa dentro de la Administración Pública.O enriquecimento sem causa pode ser conceituado como o aumento de bens que se verifica no patrimônio do sujeito em detrimento de outro, sem ter qualquer base legal para que o justifique. Assim, pode-se dizer que sua proscrição no sistema jurídico é um princípio geral do direito. Deve-se notar, entretanto, que as regras sobre enriquecimento injusto não se aplicam exclusivamente às relações entre indivíduos, mas se estendem a outras áreas do direito público.
