NANOTECHNOLOGY AND UNKNOWN RISKS: REFLECTIONS ON THE NEED OF A NEW THINKING ABOUT LAW

Resumo: The paths opened by technology have brought the possibility of exploring new scales and inaugurated a new way of understanding Nature from the Nanotechnology. Developed through an ultrasophisticated technoscientific apparatus, it makes the reflection about its infinite reaches and risks be driven by the uncertainty of the scientific models that create this new reality. In this area, Law is obliged to face complex and interdisciplinary issues, often based on a scientism that confers genuineness and credibility only on what it produces and which, due to the speed with which news transmutes, is in complete disagreement with the rhythm of legal dogma. This study, therefore, uses the inductive method of investigation, with the use of essentially bibliographical research and aims to reflect on the challenges imposed to the Legal Science, in order to indicate the need to strengthen the own parameters of decision that lead, from the best way possible, to address the nuances and challenges posed by nanotechnology.

Desarrollada a través de un aparato tecnocientífico ultrasofisticado, hace que la reflexión acerca de sus infinitos alcances y riesgos sea conducida por la certeza de la incertidumbre de los modelos científicos creadores de esta nueva realidad. En esta misa, el Derecho está obligado a enfrentar cuestiones de cuño complejo e interdisciplinario, muchas veces pautado en un cientificismo que confiere genuinidad y credibilidad solamente aquello que produce y que, por la velocidad con que las novedades transmutan, siguen en franco descompaso con el ritmo de la vida dogmática jurídica. Este estudio, por lo tanto, utiliza el método inductivo de investigación, con empleo de investigación esencialmente bibliográfica y tiene como objetivo efectuar una reflexión acerca de los desafíos impuestos a la Ciencia Jurídica, en el sentido de indicar la necesidad de fortalecimiento de los parámetros propios de decisión que conducen, mejor manera posible, al enfrentamiento de los matices y desafíos impuestos por la Nanotecnología.Tradução do resumo para o espanhol.Os caminhos abertos pela tecnologia trouxeram a possibilidade de explorar novas escalas e inauguraram uma nova forma de entender a Natureza a partir da Nanotecnologia. Desenvolvida através de um aparato tecnocientífico ultrasofisticado, faz com que a reflexão acerca de seus infinitos alcances e riscos seja conduzida pela certeza da incerteza dos modelos científicos criadores desta nova realidade. Nesta seara, o Direito é obrigado a enfrentar questões de cunho complexo e interdisciplinar, muitas vezes pautado em um cientificismo que confere genuidade e credibilidade somente aquilo que produz e que, pela velocidade com que as novidades transmutam, seguem em franco descompasso com o ritmo da dogmática jurídica.
