Historical-political interferences and advances and setbacks of the Law of Guidelines and Bases of National Education in the Field of Special Education

Resumo: Thinking about the enactment of the Law of Guidelines and Bases of National Education (LDB) in 1961, the subsequent versions and impacts for the área of Special Education, it was problematized how the political transformations that occurred between the decades of 1950 and 1990 influenced the course of the different documents of LDB versions and in the construction of chapters for the area of Special Education. For this, this article aims, from a historical and political contextualization at the time, to describe and compare the advances and setbacks contained in the chapters intended for Special Education in the three documents promulgated of the Law of Guidelines and Bases of National Education. Thus, through a descriptive research with documentary and bibliographic analysis, the present work presents the historical, political and terminological transformations that occurred in LDB 4.024/61, LDB 5.692/71 and LDB 9.394/96, with regard to Special Education. The results point to the direction and disengagement of the State with the education of special education students. It is concluded that historical-political transformations have a direct impact on the way special education is viewed in the educational field, as well as on the terminologies used and on the services provided to the target public.

Para ello, este artículo pretende, desde una contextualización histórica y política de la época, describir y comparar los avances y retrocesos contenidos en los capítulos destinados a la Educación Especial en los tres documentos promulgados de la Ley de Lineamientos y Bases de la Educación Nacional. Así, a través de una investigación descriptiva con análisis documental y bibliográfico, el presente trabajo presenta las transformaciones históricas, políticas y terminológicas ocurridas en LDB 4.024/61, LDB 5.692/71 y LDB 9.394/96, con respecto a la Educación Especial. Los resultados apuntan a la dirección y desvinculación del Estado con la educación de los estudiantes de educación especial. Se concluye que las transformaciones histórico-políticas tienen un impacto directo en la forma en que se ve la educación especial en el campo educativo, así como en las terminologías utilizadas y en los servicios prestados al público objetivo.Pensando na promulgação da Lei de Diretrizes e Bases da Educação Nacional (LDB) em 1961, as versões subsequentes e os impactos para a área da Educação Especial, problematizou-se como as transformações políticas ocorridas entre as décadas de 1950 e 1990 influenciaram no percurso dos diferentes documentos das versões da LDB e na construção dos capítulos destinados à área da Educação Especial. Para isso, este artigo visa, a partir de uma contextualização histórica e política à época, descrever e comparar os avanços e retrocessos contidos nos capítulos destinados à Educação Especial nos três documentos promulgados da Lei de Diretrizes e Bases da Educação Nacional. Assim, por meio de uma pesquisa descritiva com análise documental e bibliográfica, o presente trabalho apresenta as transformações históricas, políticas e mudanças terminológicas ocorridas na LDB 4.024/61, LDB 5.692/71 e na LDB 9.394/96, no que se refere à Educação Especial. Os resultados apontam para o direcionamento e descompromisso do Estado com a educação dos alunos da Educação Especial.
