Law no. 5,692 of 1971 and the Education Guidelines and Basics Law no. 9,394 of 1996: approaches and distances in the organization of education in basic education

Resumo: The laws that regulate Brazilian education have undergone several changes over the past decades. In this article we have the objective of analyzing the approaches and distances between the organization of education with emphasis on professional education that are provided in Law No. 5,692 of 1971 and the Law of Guidelines and Bases of Education No. 9,394 of 1996 (LDB/96). The period between 1971 and 1996 is justified because Law nº 5.692/71 lasted from 1971, during the military regime, until 1996 when it was revoked during the re-democratization period by LDB/96. The study proposed here is based on bibliographic review and documentary analysis. In view of the above, we have two questions: How was teaching organized in levels and modalities in Law nº 5.692/71 and LDB/96 in the year of its promulgation? What are the approximations and possible distances in the organization of professional education between the two laws? The research points out several aspects, among which we can conclude that the organization of teaching in Law nº 5.692/71 and in LDB/96 in the year of its promulgation is approaching in several ways: length of time for the levels of teaching, free teaching of 1st degree, current elementary education. The number of school days is also approximate, with a difference of only 20 days between the two legislations. As a distance, we identified that in Law 5.692/71 there was a greater emphasis on training for the labor market, while in LDB/96 a more human-oriented view.

En este artículo tenemos el objetivo de analizar las aproximaciones y distancias entre la organización de la educación con énfasis en la educación profesional que están previstas en la Ley Nº 5.692 de 1971 y la Ley de Directrices y Bases de la Educación Nº 9.394 de 1996 (LDB/96). El período entre 1971 y 1996 se justifica porque la Ley Nº 5.692/71 duró desde 1971, durante el régimen militar, hasta 1996, cuando fue revocada durante el período de redemocratización por el LDB/96. El estudio que se propone aquí se basa en la revisión bibliográfica y el análisis documental. En vista de lo anterior, tenemos dos preguntas: ¿Cómo se organizó la enseñanza en niveles y modalidades en la Ley nº 5.692/71 y LDB/96 en el año de su promulgación? ¿Cuáles son las aproximaciones y las posibles distancias en la organización de la enseñanza profesional entre las dos leyes? La investigación señala varios aspectos, entre los cuales podemos concluir que la organización de la enseñanza en la Ley nº 5.692/71 y en el LDB/96 en el año de su promulgación se está acercando de varias maneras: duración de los niveles de enseñanza, enseñanza gratuita de 1º grado, enseñanza elemental actual. El número de días lectivos también es aproximado, con una diferencia de sólo 20 días entre las dos legislaciones. A distancia, identificamos que en la Ley 5.692/71 hubo un mayor énfasis en la capacitación para el mercado laboral, mientras que en el LDB/96 una visión más humana.As Leis que regulamentam a educação brasileira sofreram diversas alterações ao longo das últimas décadas. Neste artigo, temos o objetivo de analisar as aproximações e os distanciamentos entre a organização do ensino com ênfase na educação profissional que estão previstos na Lei nº 5.692 de 1971 e na Lei de Diretrizes e Bases da Educação nº 9.394 de 1996 (LDB/96). O período entre 1971 e 1996 se justifica porque a Lei nº 5.692/71 perdurou de 1971, durante o regime militar, até o ano de 1996 quando foi revogada no período de redemocratização pela LDB/96. O estudo aqui proposto tem como base a revisão bibliográfica e análise documental. Diante do exposto, temos duas questões: Como se organizava o ensino em níveis e modalidades na Lei nº 5.692/71 e na LDB/96 no ano de sua promulgação? Quais são as aproximações e os possíveis distanciamentos na organização da educação profissional entre as duas leis? A pesquisa nos aponta diversos aspectos, dentre eles, podemos concluir que a organização do ensino na Lei nº 5.692/71 e na LDB/96 no ano de sua promulgação se aproximam de diversas formas: tempo de duração para os níveis de ensino, gratuidade do ensino de 1º grau, atual ensino fundamental. A quantidade de dias letivos também é aproximada, com uma diferença de apenas 20 dias entre as duas legislações.
