The means for the titling of remaining quilombola territories in Brazil

Resumo: The greatest black flag has always been resistance to the system that has excluded them for centuries. Thus, numerous rights were acquired, including the right to historically inhabited territory, however the title of their territories is still characterized as a distant dream for the vast majority of the remaining quilombo communities in Brazil. In order to analyze this problem, we have outlined the general objective: to analyze the stages of the process of titling quilombola territories in Brazil. Bibliographic research in books, theses, dissertations, journal articles, laws, etc. was used in the methodology, using a qualitative approach of the descriptive type. Research in documents from Fundação Cultural Palmares - FCP and the National Institute of Colonization and Agrarian Reform - INCRA (Regional Superintendence - SR 24). We conducted an interview with an INCRA SR 24 representative for further clarification on the processes of land tenure regularization in quilombola territories in Brazil. It was found that the conquest of the title of the territory in the remaining communities goes through bureaucratic issues and happens very slowly, even after the insertion of article 68 in the Act of Transitional Constitutional Provisions - ADCT of the Federal Constitution that guarantees the remaining quilombo communities right to traditionally occupied territories. The insertion of communities in government public policies in the medium and long term is a fundamental factor to guarantee the improvement in living, education, health and work conditions, within these communities. However, the conquest of the territory does not always guarantee access to actions and projects for their social and economic development.

Por lo tanto, se adquirieron numerosos derechos, incluido el derecho a un territorio históricamente habitado, sin embargo, el título de sus territorios todavía se caracteriza como un sueño lejano para la gran mayoría de las comunidades quilombo restantes en Brasil. Para analizar este problema, hemos delineado el objetivo general: analizar las etapas del proceso de titulación de los territorios de quilombola en Brasil. La investigación bibliográfica en libros, tesis, disertaciones, artículos de revistas, leyes, etc. se utilizó en la metodología, utilizando un enfoque cualitativo de tipo descriptivo. Investigación en documentos de la Fundação Cultural Palmares - FCP y el Instituto Nacional de Colonización y Reforma Agraria - INCRA (Superintendencia Regional - SR 24). Realizamos una entrevista con un representante de INCRA SR 24 para obtener más aclaraciones sobre los procesos de regularización de la tenencia de la tierra en los territorios de quilombola en Brasil. Se descubrió que la conquista del título del territorio en las comunidades restantes pasa por problemas burocráticos y ocurre muy lentamente, incluso después de la inserción del artículo 68 en la Ley de Disposiciones Constitucionales Transitorias - ADCT de la Constitución Federal que garantiza a las comunidades quilombo restantes el derecho a los territorios tradicionalmente ocupados. La inserción de las comunidades en las políticas públicas del gobierno a mediano y largo plazo es un factor fundamental para garantizar la mejora de las condiciones de vida, educación, salud y trabajo dentro de estas comunidades. Sin embargo, la conquista del territorio no siempre garantiza el acceso a acciones y proyectos para su desarrollo social y económico.A maior bandeira do negro sempre foi a resistência ao sistema que os excluiu por séculos. Assim, inúmeros direitos foram adquiridos, inclusive o direito ao território historicamente habitado, entretanto a titulação de seus territórios, ainda, é caracterizada como um sonho distante para a grande maioria das comunidades remanescentes de quilombo do Brasil. Visando uma análise dessa problemática traçamos como objetivo geral: analisar as etapas do processo de titulação de territórios quilombolas no Brasil. Utilizou-se na metodologia a pesquisa bibliográfica em livros, teses, dissertações, artigos de periódicos, leis etc., utilizando uma abordagem qualitativa do tipo descritiva. A pesquisa em documentos da Fundação Cultural Palmares - FCP e do Instituto Nacional de Colonização e Reforma Agrária - INCRA (Superintendência Regional - SR 24). Realizamos entrevista com um representante do INCRA SR 24 para maiores esclarecimentos sobre os processos de regularização fundiária dos territórios quilombolas no Brasil. Constatou-se que a conquista da titulação do território nas comunidades remanescentes passa por questões burocráticas e acontece de forma muito lenta, mesmo após a inserção do artigo 68 no Ato das Disposições Constitucionais Transitórias – ADCT da Constituição Federal que garante às comunidades remanescentes de quilombo o direito aos territórios tradicionalmente ocupados. A inserção das comunidades nas políticas públicas governamentais a médio e longo prazo é fator primordial para garantir a melhoria nas condições de vida, educação, saúde e trabalho, no interior dessas comunidades.
