STATE AND ENVIRONMENTAL INJUSTICE: REFLECTION ON BRAZILIAN ENVIRONMENTAL POLICY FLEXIBILIZATION

Resumo: The State’s role in guaranteeing ecological balance as per the Brazilian Constitution (1988) incites a discussion about environmental policies in Brazil. In this context, the present piece examines the effects of excessively flexible environmental laws, which may harm whatever has been established so far. What path will the Brazilian Government follow for environment protection? Will it build stronger or weaker green regulations? The study of the State (within Political Philosophy) has aided in answering those questions. Besides the aforementioned subjects, this paper also regards Neo-extractivism, a new set of practices followed by some Governments in Latin America, including Brazil. Ultimately, the method consisted of literature review and documental analysis that included laws, bills, and deliberations linked to the failure of environmental protection in Brazil. In conclusion, this research uncovered the State’s incompetent efforts towards environmental compliance.

In conclusion, this research uncovered the State’s incompetent efforts towards environmental compliance.O artigo propõe-se a empreender uma reflexão acerca do papel desempenhado pelo Estado na garantia constitucional a um meio ambiente ecologicamente equilibrado, o que conduzirá a um estudo dos rumos aos quais vem trilhando a política ambiental brasileira. Assim, tem-se por objetivo compreender como a adesão a uma política ambiental mais flexível e maleável viola as garantias de proteção existentes em detrimento da vedação ao retrocesso ecológico, bem como de que forma o caminho ao qual indica trilhar o Estado brasileiro na temática ambiental pode implicar na construção de cenários de injustiça ambiental. Aliado a um breve estudo da Teoria Geral do Estado, outra categoria conceitual a ser explorada ao longo do artigo é o neoextrativismo, que afigura-se como um novo olhar sobre a agenda pública ambiental. A metodologia utilizada encontra-se alicerçada em uma revisão de literatura, com uma abordagem qualitativa das categorias conceituais articuladas, conjugada com uma análise documental pautada em alguns instrumentos jurídico-administrativos (leis, projetos de leis, deliberações) que simbolizam o momento de desmonte ambiental brasileiro.
