Financing basic quality education: the ways and paths to the new Fundeb

Resumo: The article aims to analyze the trajectory of advances and setbacks in Brazilian educational legislation until the approval of Constitutional Amendment nº 108/2020. Using documentary and bibliographic research, it addresses the evolution of legal guarantees that support the right to quality education; the funding policy for financing and its inability to correct inequalities in the provision of education; the achievements brought by the PNE and the setbacks of EC No. 95/2016 that made it unfeasible and, finally, deals with the achievement of EC No. 108/2020 making FUNDEB permanent and constitutionalizing the CAQ. He concludes by pointing to the need for social mobilization that guarantees a regulatory process for FUNDEB and CAQ that manages to give concrete quality to education.

À l'aide de recherches documentaires et bibliographiques, il aborde l'évolution des garanties juridiques qui soutiennent le droit à une éducation de qualité; la politique de financement du financement et son incapacité à corriger les inégalités dans l'offre d'éducation; les réalisations apportées par le PNE et les revers du CE n ° 95/2016 qui l'ont rendu irréalisable et, enfin, porte sur la réalisation du CE n ° 108/2020 rendant le FUNDEB permanent et constitutionnalisant le CAQ. Il conclut en soulignant la nécessité d'une mobilisation sociale qui garantit un processus de régulation pour le FUNDEB et le CAQ qui parvient à donner une qualité concrète à l'éducation.O artigo objetiva fazer uma análise da trajetória de avanços e retrocessos na legislação educacional brasileira até a aprovação da Emenda Constitucional nº 108/2020. Utilizando pesquisa de base documental e bibliográfica aborda a evolução das garantias legais que sustentam o direito à educação de qualidade; a política de fundos para o financiamento e sua incapacidade em corrigir as desigualdades na oferta do ensino; as conquistas trazidas pelo PNE e os retrocessos da EC nº 95/2016 que o inviabilizaram e, por fim, trata a conquista da EC nº 108/2020 tornando permanente o FUNDEB e constitucionalizando o CAQ.
