This master’s dissertation aims to address the theory of the “Dialogue des Sources” as an interpretation and application method of legal standards. In addition, it aims at helping Law advance in the challenge of protecting human beings and seeking solutions that are more just and in accordance with fundamental rights, especially in the protection and promotion of persons with disabilities. The deductive method was used as an approach and the monographic method was used as a procedure. Moreover, in the case of the analysis of fundamental rights, it was necessary to use legal arguments due to difficulty of interpretation and proper application of principles. The “Dialogue des Sources” proved to be an instrument for the execution of fundamental rights, since it is a method of interpretation and application of legal norms that solves issues in accordance with the current challenge of the right of protection of human beings and promotes the search of just solutions consistent with the Constitution. In conclusion, the “Dialogue des Sources” can also redesign the norms of the new legal model for the promotion of persons with disabilities due to the legal values inherent to these persons and to the values established by the Constitution and by the International Convention on the Rights of Persons with Disabilities.
