Resumo: This research aims to analyze the aspects of the right to be forgotten from the perspective of other personality rights, especially the right to information. The analysis will be done from the perspective of the individual inserted in a computerized society, in which Internet resources and all other technologies create an unlimited and timeless memory, so as to directly affect the individual memory of the subject. Within this society, the right to be forgotten justifies the importance of its regulation and application while colliding with other fundamental rights. This, this research seeks to analyze historical judicial decisions in both Brazilian and international courts in order to demonstrate how this right has been applied and the relevance of its recognition in a democratic State under the rule of law that guarantees fundamental rights. The deductive method used will be the bibliographical research.

A análise será feita sob a ótica do indivíduo inserido em uma sociedade informatizada, na qual os recursos da internet e todas as outras tecnologias criam uma memória ilimitada e atemporal, de forma a afetar diretamente a memória individual do sujeito. Dentro dessa sociedade, o direito ao esquecimento justifica a importância de sua regulamentação e aplicação ao passo que entra em colisão com outros direitos fundamentais. Assim, esta pesquisa busca analisar decisões judiciais históricas tanto nos Tribunais pátrios quanto em Tribunais internacionais, a fim de demonstrar como esse direito vem sendo aplicado e a relevância de seu reconhecimento em um Estado democrático de Direito garantidor de direitos fundamentais.
