Resumo: The crime of passion, does not have a practical solution in the current Brazilian criminal law, mainly the homicide passion, this crime ends up being judged as a common homicide provided for in the Penal Code. In this way, this work was carried out using the hypotheticaldeductive approach, trying to define the crime of passion and its criminological and psychological aspects, bringing an exposition of famous cases that occurred in Brazil and that were highlights in the media. The theses used in the trial of these crimes and, consequently, their punishment in the present time have been demonstrated. For this study were used doctrines, scientific and journalistic magazines and electronic documents. It was verified in the course of this work that the crime of passion needs a proper criminal type and a punishment sometimes more severe.

Desta forma esse trabalho foi realizado a partir do método de abordagem hipotético-dedutivo, buscando definir o crime passional e seus aspectos criminológicos e psicológicos, trazendo uma exposição de casos célebres ocorridos no Brasil e que foram destaques na mídia. Foram demonstradas as teses usadas no julgamento de tais crimes e consequentemente sua punição na atualidade. Para esse estudo foram utilizadas doutrinas, revistas científicas e jornalísticas e documentos eletrônicos.
