Resumo: The present work aims to study the criminal procedural instrument called “defensive criminal investigation”. To this end, the research was subdivided into two lines, the first analyzes the main theoretical foundations of the mechanism, while the second studies the practical aspects, aiming to demonstrate the importance of the strategic use of this procedure to implement the guarantees of broad defense and contradictory, since that respecting constitutional, legal and ethical limits.
