Reform of the Judiciary and its Social Representation in the Perspective of Magistrates from Bahia’s State Court.

Resumo: The present research aims to get to know social representations of the judiciary reform by judges of the Court of Justice in the State of Bahia, in Brazil, more specifically, trying to point out how these differ from those presented by the servers. The epistemic-methodological approach was operationalized through the theory of social representations and content analysis, proposed by Bardin. In the research, four dimensions emerged from the analysis of evoked words and explanatory texts, which are related to management reform, impacts on the judiciary, impacts on the citizen, legislation. The results were compared to other studies that focus on servers, which showed that, from the servers’ point of view, the management aspects were not highlighted, but, from the point of view of first instance judges, this is a category of the most important. Finally, the researchers present considerations related to the strategy of the Brazilian National Council of Justice  in what comes to management in the judiciary. Keywords: Judicial power, Judiciary, Magistrates, Theory of social representations.

El enfoque epistémico-metodológico fue operacionalizado por  la teoría de las representaciones sociales y del análisis de contenido. En la investigación surgieron cuatro dimensiones, a partir del análisis de palabras evocadas y de los textos explicativos, que están relacionadas con la reforma gerencial, los impactos en el poder judicial, los impactos para los ciudadanos y legislación. Los resultados fueron comparados con estudios anteriores realizados con foco en los servidores. La confrontación reveló que, desde el punto de vista de los magistrados de primera instancia, los aspectos gerenciales constituyen una categoría de las más importantes, en oposición a resultados anteriores enfocados en los servidores. Por último, los investigadores presentan consideraciones relacionadas con la estrategia del Consejo Nacional de Justicia Brasileño y la gestión en el poder judicial.Palabras clave: Poder Judicial, Reforma, Jueces, Teoría de las Representaciones Sociales. A presente pesquisa investiga como os juízes do Tribunal de Justiça da Bahia constroem a representação da reforma do Judiciário no contexto brasileiro. A abordagem metodológica foi operacionalizada por meio da teoria das representações sociais e da análise de conteúdo. Na pesquisa emergiram quatro dimensões, a partir da análise de palavras evocadas e dos textos explicativos, que estão relacionadas a: reforma gerencial, impactos no judiciário, impactos para cidadão, legislação. Os achados foram comparados com outros estudos com foco nos servidores. O confronto revelou que, a partir do ponto de vista dos servidores, os aspectos gerenciais não obtiveram destaque, mas a partir do ponto de vista dos magistrados de primeira instância esta é uma categoria das mais importantes.
