Analysis of contractual amendments in public constructions in the state of Minas Gerais

Resumo: The high demand for infrastructure in Brazil and the advancement of technological resources in construction industry generated an increase of projects complexity. Consequently, contractual amendments become recurrent in public constructions. Thus, the present paper aims to present a panorama of the engineering contracts signed by the State of Minas Gerais, as well as to show a case study of revitalization in Belo Horizonte/MG. For this purpose, 32 engineering public contracts in the last two years were analyzed, considering the amendments of costs and terms of those contracts. In particular, the case study showed that the mentioned construction work had several contractual amendments due to insufficiency and incompatibilities of projects. Moreover, the undersized contractual plan may be a consequence of divergent data and financial resources that compromised the estimation of the overall cost. However, despite the constant use of this tool in public contracts, it is understood that contractual amendments are still an important mechanism that allows the execution of construction works. This even in the absence of project specifications and adequate planning before the implementation of public enterprises.

A alta demanda por obras de infraestrutura no Brasil e o avanço dos recursos tecnológicos durante os processos na construção civil geraram o aumento da complexidade dos projetos. Em consequência, os aditivos contratuais para acréscimo de custo e prazo se tornam recorrentes em obras públicas. Assim, o presente trabalho buscou apresentar um panorama dos contratos de serviços de engenharia celebrados pelo Estado de Minas Gerais, bem como mostrar um estudo de caso de uma obra de reforma no município de Belo Horizonte/MG. Para isso, foram levantados 32 contratos de serviços de engenharia realizados pelo estado nos dois últimos anos, sendo analisados os aditivos de custos e prazos desses contratos. Em particular, o estudo de caso mostrou que a obra em questão teve diversos aditivos contratuais em virtude da insuficiência e incompatibilidades entre os projetos. Além disso, o subdimensionamento da planilha contratual se deve às divergências de dados e recursos financeiros que dificultaram a estimativa do custo total. Entretanto, apesar do uso constante dessa ferramenta nas obras públicas, compreende-se que o aditivo contratual ainda é um importante mecanismo que possibilita a execução de obras. Isso mesmo diante da falta de especificações em projetos e adequado planejamento antes da implantação dos empreendimentos públicos.
