The civil liability of internet providers in cases of revenge pornography

Resumo: The phenomenon of revenge pornography has the most expressive instrument of achievement on the internet, the practice of which is even fostered by internet providers. Given this, the question is: to what extent does Brazilian law regulate the civil liability of internet providers in cases of revenge pornography exposure? The intention is to analyze the scope of Brazilian legislation, especially the Brazilian Civil Rights Framework for the Internet, in response to the phenomenon of undue exposure of intimacy, especially among women. For this, a research was carried out using the hypothetical-deductive method, with a bibliographic and legislative review. Revenge pornography is used as an expression of gender violence, as women are constantly judged for the exercise of their sexuality. The main evidence of the work is that internet providers, must respond objectively for their participation in the harm arising from the revenge pornography linked to their bases.

O fenômeno da pornografia de vingança possui na internet seu mais expressivo instrumento de realização, cuja prática é, inclusive, fomentada por provedores de internet. Dado a isso, questiona-se: em que medida o direito brasileiro regula a responsabilidade civil dos provedores de internet nos casos de exposição de pornografia de vingança? Intenta-se, com isso, analisar o alcance da legislação brasileira, em especial o Marco Civil da Internet, na resposta do fenômeno de exposição indevida da intimidade, sobretudo de mulheres. Para isso, efetuou-se uma pesquisa pelo método hipotético-dedutivo, com a revisão de bibliografias e legislativa. Sendo assim, trabalha-se a pornografia de vingança como expressão de violência de gênero, porquanto a mulher é constantemente julgada pelo exercício de sua sexualidade. A principal evidência deste estudo é que os provedores de internet, especificamente os de conteúdo, devem responder de forma objetiva pela participação no dano advindo da pornografia de vingança vinculada em suas bases.
