Resumo: The present study aims to investigate the best way to satisfy the right of the holder of credits derived from labor legislation or resulting from work accidents in judicial recovery, considering the changes produced by Law No. 14.112/2020 of Business Recovery and Bankruptcy. The problem is posed from the hermeneutics of art. 54, §2 of Law no. 11.101/2005 and will be investigated in the light of jurisprudential precedents and specialized doctrine. The study proposes to investigate the hypothesis that the best interpretation of the aforementioned legal provision considers that the legal deadlines must be counted in a cumulative and not alternative way, recognizing that the best thing for the creditor would be to receive their rights in a timely manner, but, before the impossibility of perceiving them this way, the less worse it will be to receive them in an extended period than having to qualify for the bankruptcy process.
