Resumo: This work aims to offer a liberal case for Brazilian State’s reaction to fake news propagation in Brazil. It argues that fake news are deliberate lies whose nature is iliberal, as they are against the production and conservation of a social good, more accurately a good faith social environment and a “culture of truth”. Pointing out the existence of a normative gap and of a series of bills on the subject being discussed in the Brazilian Parliament, the work also proposes the regulation of provider’s activities based on its conceptual parameters. The research adopts the speculative method, departing from related international literature, national legislation and Brazilian National Congress bills’ analysis.

Ele argumenta que estas são mentiras deliberadas de natureza iliberal, pois contrárias à produção e conservação de um bem social, qual seja, um ambiente de boa-fé e uma “cultura da verdade”. Identificando um vácuo normativo e projetos de regulação do tema em trâmite no Legislativo Federal, propõe-se, ainda, a regulamentação da atividade de provedores pautada pelas bases conceituais esboçadas neste trabalho.
